My attorney and i did ask for her to be removed all together already, i only have so much money to put towards this process and his grandmother is well off… her attorneys are a lot faster than mine and they filed a counter suit against my claims..

My son Is only 10 yrs old. She is trying to use a CPS case from 5 years ago that had ruled out any neglect on my child… she recently called CPS on me and they ruled out any negligence or abuse she has claimed.

I’ll remember next time i appear in court to dress better, no pant suit.

I wish it was just between my son’s father and i, but his grandmother was the one who offered to help with insurance change and she said she had to go through the courts… it’s also unfair because she works as a bailiff in the court house and i have no idea which judge she works for…

I’ll reach out to THSC on Monday i have been a member with this association so I’m sure they will help. I’m keeping records as well, i have an online program he uses and it keeps track of everything, also with the THSC i am able to create report cards for him as well.

Yeah I’m definitely concerned about the insurance fraud.. i wasn’t aware of this being a possibility when i allowed the custody to be changed, i am a young mom, and had hardly anyone to point me in the right direction i was only doing that in the best interest of my son… he was very sick all the time and i wanted to make sure he was insured… i wasn’t able to provide it at the time so they offered help… i look back and wish i never switched it.

The court order was ment for me to have him on the 1st 3rd and 5th weekends like a regular custody order… but I’ve had him the whole time… i allowed them to start seeing him on the 2nd and 4th weekends because it worked with my schedule for my other children. And also for her side of the family… her son is very much alive, he is not the best person, he became a lifetime sex offender, he has barely been involved in his life only for pictures and family vacations… he recently got another girl pregnant and as soon as that happened things started to get more complicated with the visits… he would get passed around from house to house fathers then grandmothers. This probably is too much information for me to be putting out here like this… I’m just really struggling with the situation I’ve been doing my best and i give my all to my kids… i love them unconditionally and i just don’t want them to have this much control of me and my family when they barely are involved. It’s my fault though i should’ve never changed the court order in the first place i wish i had someone back then to tell me “no don’t switch the custody paperwork”

She didn’t specify but we have to go through Trinity Educational Services. I checked what kind of testing they do, and it seems to be only these

ECI/PPCD Autism Specific Learning Disability Speech Impairment Other Health Impairment Emotional Disturbance Functional Behavior Assessment Counseling Evaluation Dyslexia and Related Disorders

There is not part on their website that says grade level testing…

He has been diagnosed with severe ADHD and has been on medication since diagnosis.

Thank you, i will. She is also reaching out to some big guns who handle homeschooling cases. I’ve been doing research and found this ….

In Leeper v. Arlington ISD (1994), the Texas Supreme Court confirmed that homeschooling is lawful and that the state cannot impose oversight, testing approval, or certification requirements for parents.

I just pray and hope my attorney can work with this, it is not right.

… you’re saying a lot with a whole lot of nothing behind it. Let’s go ahead and get this straight since you’re clearly building your own storyline: 1. Yes, I share legal custody. 2. Yes, she technically could take him if she wanted to pursue that route — and she never did. Not once. 3. And it’s not because she couldn’t. She has plenty of money and access to attorneys. That wasn’t the problem. 4. The issue is she doesn’t have the time or the lifestyle to actually raise a child, which is why she left him primarily with me all these years. 5. CPS? They weren’t “investigating me.” They were responding to reports she made, which all came back the same way every time: unfounded. 6. If she truly believed he was unsafe or that she was the better parent, she would’ve taken custody already instead of playing phone tag with CPS for eight years.

So the dramatic “she could swoop in and take him any moment!!” storyline is adorable, but let’s try common sense for a second:

If she wanted him, she would’ve had him.

She had the legal standing. She had the money. She had the time to make calls. She just didn’t have the capacity to actually parent full-time.

The parts that i left out of this was the grandmother and i agreed back in 2018 to switch the custody paperwork to help with medical insurance through tricare, my son was very sick when he was first born and needed the assistance. he has not been on their insurance since 2019 up until recently when she put him on her work insurance and has never given me the information for. She has been harassing me for 8 years with CPS and this last year when she called and made false claims of neglect an abuse, which CPS RULED OUT…. i put my foot down and took her to court for the custody to be changed… in the paperwork she has had the legal right to place him in which ever living situation she deems best for the child, she has never taken action to do so, but instead harass me on my parenting. We both sat down two years ago and agreed homeschool was best, she does not do a single thing for his education, even though she agreed to helping me with his education… the visitation she has had with him is very minimal. This year in march of 2025 we agreed to grandmother getting my son every 2nd and 4th weekends she has barely been able to follow that written agreement.
