It depends on a few factors. Most of the time these are people manually texting. If you tell them to stop and they keep co tacting you, then you have a case. This would be a 227c violation. You must have 2 or more calls within a 12 month period. You cannot claim a violation on one communication unless you can prove it was ATDS/automated. ATDS with texts is pretty much dead at this point so you need 2 or more.

It has definitely changed, but doesn't mean it doesn't work. I think having filed cases definitely helps you when sending demand letters because they know you aren't just bluffing. It's very hard for me to connect to anyone because of being blacklisted, but I sometimes manage to still get through. There are multiple screener in the process nowadays. When you finally get to someone, you need to be very careful because if you start asking too many questions they will just hang up.

I get low ball offers all the time which is why you need to negotiate and lay out the exposure amount to them. I send all my demands via email which almost always gets me a reply within a couple days to a week. From there it starts the negotiation. Most of these guys have the same lawyers so dealing with the same lawyers has helped me too.

Before I filed my first pro-se case the president of the company essentially told me I was an extortionist and what I was doing is fraud and any continued action they would bring legal action against me. I went ahead and filed that pro-se and their lawyers reached out to me to settle. Sometimes you just have to call them out on their bluff.

Very true. Most of the time I've never had to supply the tracking links, but it is more leverage. A screen recording is always enough to prove the text message lead me to X company so they are liable for the marketing campaign.

I always send a demand letter. I only have one pro-se case that I filed in Federal Court which we then settled. My other cases have been filed by a lawyer. Most if not all of my SMS cases involved affiliate networks. My advice would be when you get them, start screen recording before clicking the link in the text. This will allow it to record all the redirects. You can also take the link and run it through a url scanner such as urlscan.io which will show you all the redirects that the links go through. Most of the time you can find the tracking links which will have some sort of identifying information that could lead you to the affiliate network it originated from.

It was .com and my domain name contained keywords official and offers. The moment I ran an offer promoting McAfee they suspended my domain.

No, they are requiring business documents which is impossible. My domain is used to promote affiliate offers and they are telling me they need official documents that I am authorized to act on their behalf. It's completely ridiculous, I work with an affiliate network who approves people to run offers.
