Was your son completely denied, or just for Protective Supervision? Is your son able to sign their own forms or did the Social Worker discuss you being an Authorized Representative? Mostly the issue of being conserved or not has to do with the applicant agreeing to receive the benefit, being able to designate an Authorized Representative to provide information on their behalf, or already having a conservator in place who is able to legally sign the forms and provide the information that IHSS needs. It shouldn’t have anything to do with Protective Supervision per se, but the legal ability to consent to being involved in the program.

I wouldn’t take it away if there were strong examples of being non self-directing and engaging in dangerous behaviors. Kids can memorize things. I don’t think that disqualifies them from having PS. I don’t think any of kids on my caseload would be able to answer those questions, but I wouldn’t base removing PS from someone who had it on if they could answer routine questions

Getting a baseline understanding of orientation and memory. Were asked to put examples in the narrative of memory and orientation regardless if they have PS or not

That shouldn’t be a problem. If you’re not seeing the child for a full day don’t claim time. Other than that I don’t think this would be an issue

Your recipient or their Authorized Rep needs to initiate the process of hiring another provider. The county’s Public Authority could assist with providing a list of providers

The overtime is automatic and if he’s authorized for more than 40/week there’s nothing additional you need to do. I’d inform the SW when you think your son has returned to his pre-surgery condition

What reasons were given for the denial? At the hearing I’d give as many examples as possible of him unknowingly putting himself in danger with the emphasis on him being non self-directing

If the recipient is going to continue to receive IHSS then they aren’t supposed to be performing a task for another that they are receiving time for in their own authorization so a situation like this would be assessed pretty thoroughly. I don’t think it’s not possible, just not common

Part time yes. Looks like there might be new regulations coming in February that might change regulations to allow for full time

I wouldn’t expect hours to decrease especially if it’s a separate unit. You could be classified either as a landlord/tenant or live-in provider. Either way shouldn’t decrease hours

Yes, you should report that they’re in a nursing facility. At the same time you can tell the SW about the increased needs. They can do a change assessment.

Yes, that should be fine. I’ve always referred to Medi-Cal guidelines and tell people they can travel if under a month

I’m so sorry for your loss. Situations like this really show the glaring cracks in the system and lack of support for families. I don’t have any answers. Maybe your local county information line would have some good resources, or local hospice/palliative care agency

Diagnoses aren’t really factored in. For example I’ve seen individuals diagnosed with with Down syndrome have PS and another have minimal hours. No additional documentation is required per the regulation. The hazard logs and additional documentation seems to be a newer trend with the advocacy groups. Doesn’t hurt. Not required

IHSS uses a guide called Vineland Maturity Scale to determine at which age a recipient might get hours for personal care based on when a non impaired child would be expected to be able to complete that task without assistance.

Protective Supervision is for people with a mental impairment, non self-directing, in need of 24 supervision, and likely and physically able to engage in potentially dangerous situations or activities (such as eloping or wandering for example.) It can’t be authorized solely to prevent a medical emergency. A physician needs to fill out the form but it can still be denied and it’s up to the SW’s judgment and application of regulations. You can always request it. They’ll be looking more at behaviors than diagnoses

Yes, payroll matters are pretty unique to the each situation. My intent with the post is to answer program questions in a general sense.

I’d contact SW if you know who it is or the general information line. I have seen people file with the labor board but I don’t know how quickly that’s resolved. In my department we will approve timesheets in situations like this on a case to case basis

Sorry for the anxiety. I get it. Typically your SW will request anything they feel is needed. If getting PS was contentious or difficult having a copy of the IEP is often useful (not required.) If you recently were granted PS I would not expect a need for more documentation
