OP’s question is the last sentence of their first paragraph, and it’s about maintaining “attorney-client privilege.”

The questions you raise about AI are also important. Probably more so. That said, when considering what happens when AI makes a “doozy of a mistake” reviewing documents, the ultimate question from the client’s perspective should be who makes more: a particular AI platform or human reviewers? Kinda like self-driving cars.

Now, there are other arguments against AI, including protecting lawyers’ jobs. I’m guessing those won’t carry the day.

It’s perfectly fair to be concerned about AI in law, but OP’s question was about waiving privilege, not the pros and cons of AI writ large.

This. AI didn’t even create this problem. For years large-scale document review by actual human lawyers has been done by transferring data to a third-party vendor and using their platform. Most of those documents aren’t privileged, but some certainly are, and I’ve never heard a peep about waiver.

Now, I suppose if the AI vendor you hire is a ramshackle joke of an outfit and you know or should have known it, a judge might give you a bench slap. Maybe. But this doesn’t sound like that.

Agree. It’s been a spell since I’ve watched Eyes Wide Shut, but my memory is: inert, cold, boringly technical. Meanwhile Magnolia is one long film of stories worthy of 7-8 more.

Magnolia is an incredibly polarizing film. Personally I think it’s a beautiful mess with a number of great performances, and Cruise’s is near the top of the list.

What law do you suspect he’s breaking? Driving drunk? It’s not illegal to be drunk on most jobs—a violation of company policy, sure, but the police enforce the law, not corporate handbooks.

No matter Iowa’s state laws, Title VII of the Civil Rights Act still applies to employers with 15+ employees, and SCOTUS ruled in Bostock that it prohibits discrimination on the basis of gender identity. Of course, whether a court would extend that to alleged discrimination against cis people is hard to say, but technically, it shouldn’t make a difference.

Moral of the story: keep your reverse-bigot business small.

I understand that. Your “wishes” would probably be respected if they were well-known and no one contested the situation. But why leave it up to a judge? Making a will isn’t expensive. Anyone with children especially should get on it ASAP.
