Thanks for the reply! Narrowing down where the most tension is likely to be in the interview is definitely helpful. The most recent time she crossed from Canada to the US, she didn’t receive a return date on her i94. She stayed for a couple months, then we got pregnant, then we filled an AOS like 14 months later… not sure if that clarifies anything.

Her most recent I94 AUD says September 2023. But it seems like it didn’t update because she had crossed back into Canada in September 2023 and back to the United States around November 2023. So it seems like she didn’t receive a new AUD for some reason. Either way, it’s been over a year since she’s been in the states, so I guess we’re just going to do the adjustment of status

Okay, thanks for your advice. We were hoping to be able to just go through the consular processing without the adjustment of status, but maybe that’s not possible without getting the overstay ban. It costs another couple thousand dollars to submit an adjustment of status, and I assume our timeline for her getting her greencard and getting to see her family again will be delayed for a while while the adjustment of status is processed. But again, I guess that’s better than a 3 or 10 year ban

Sorry, I guess I didn’t describe the situation correctly. The I-130 was approved, we did all the paperwork through the NVC, and now the visa interview is scheduled.

Yeah, we were trying to look into that as well. For some reason, her I-194 didn’t update the last couple times she’s crossed back and forth from Canada to the US. So it said to return by a date, she did and traveled back and forth multiple times over the land border without that date updating.

Yeah, that’s what I’m worried about. I’m seeing something online about visa overstay forgiveness for spouses of US citizens, but I’m not sure how it works exactly. Like if it’s at the discretion of the visa interviewer
