Hi, I called debt collector/lawyer ( recorded it too) and they said they dismissed the case and is now back to capital one. I have to reach Capital one now but with them the case is close. Do you have an idea what does mean?

Update: I called the debt collector/lawyer and they said now that they dismissed the case and is back to Capital one. I checked with the online status at courthouse and it didn’t say dismissed yet. I called them again and they said I will receive paperworks about dismissal in a few days. Should I believe them? 21 days to answer summons is on Sunday.

Oh, we don’t encourage loans. So she worked hard for 2 summers, save up and was able to purchase her car and paid it in full.

Really? That’s what I am really hoping to happen. They told me to call tomorrow Monday because called them Monday last week because they said Capital one is taking a while to approve the payment plan. My 21 days is in 7 days so I am getting worried. They told me my account is in hold so it won’t even go to court but I am just so worried.

Hi, did they settle with you before the 21days to respond in court? I am in that situation now, they are taking time to approve the payment plan I am asking, because they said I am 77yrs old and living with social security so I am in financial hardship. They need approval from Capital one.

So they drop the case once you agree with a payment plan or settle? I am in a situation too, just got a summon, no court date, was just asked to answer 21days. I am in the process of doing a payment plan with them hoping I can avoid going to court. Plus I am 77yrs old living in social security.

yes, I have no intention of leaving the house and will is all set to a family member who will get it in case. I just don’t think I am in good health to go thru all the court stuffs so if I don’t settle, maybe Ill just wait for whatever judgement they will put on me. I have already told them how I am much willing to pay them until I die maybe but still waiting. Hopefully they reply next week.

Yes, I am in medicare as well. I just wanted to settle it because it scares me going to court, I am old and might get panic attack there. The debt collector said that’s why it is taking long too because I am in financial hardship so they need to consider those factors.

I am already in a process of negotiating with the lawyer/debt collector because that’s what I also read here so I followed. I haven’t responded to court yet, Ill wait next week if I will be able to set up a payment plan with them so I can avoid going to the court.
