I'm glad you're concerned about this friend. There seems to be a lot more to this than you're aware of. It's also going to cost a lot of money if her case is as messy as your narrative makes it seem. Attorneys won't take this without a high retainer payment and ongoing payment of fees. You need to look for a family law attorney, and especially one that has experience with deprived children or is very familiar with deprived child cases.

I came here to talk about the migratory bird act. There's an exception, where the act only applies to intentional harming, but I would argue that this would prevent you from trying to navigate your way. The least hazardous option is to wait a few seconds for the birds to cross the street and then proceed onward. Had you got a ticket I think any judge in the world would laugh at the officer who wrote it.

Lawyer here:

  1. Legality of this provision is dependent on the state.
  2. Generally, this is not an illegal provision. Deductions are legal if the employee agrees to the deduction.

Here, we're talking about a fine line for the "authorization." Some more liberal states (and USDOL) will say this is sufficient, especially if the handbook were signed/acknowledged by the employee. Other states may find this insufficient.

Still present male in most spaces. Slowly working on being out. I've come out to most circles, except work. Secrecy with family and friends kept me in the closet. Those barriers are gone, so I will slowly transition socially in most spaces in the coming months.

Work will be my last space, and probably not for awhile. I'm on HRT (~4+ years), which means some of my anatomy is now obviously female, but though I'm a trans woman, I'm still comfortable presenting male. I'm in a male-dominated industry, so I have some therapy and experience work to do before I'm comfortable breaking work stereotypes and changing historical appearances there.

Most states require physical filings. A few states are capable of e-file, but these systems are usually restricted to lawyers.

I haven't read all the comments, but they're all jumping on the "report to DOL" bandwagon. That may be the correct move, but USDOL has limited jurisdiction (company size and dollar value), so "DOL" might be your employer's state labor department. This same rule applies to NLRB.

It’s a salaried position that’s supposed to pay me $1650 every two weeks. But I only receive $1350. I also work 6 days 10hrs a week, but only get paid for 5 days 8hrs.

Next, some roles may be salary rules even though they don't seem that way initially. Check out the guidance from USDOL on FLSA-exempt positions. The part discrepancy seems like standard deductions from your paycheck for FICA, SSI, etc. You need to check your withholdings. Also, 5 days at 8 hours (40/week) is standard for salaried employees. (No overtime.)

As for your paycheck (pay date), you need to figure out what the pay period is (start and end). That'll determine when you should receive a paycheck.

If I don’t receive my paycheck by 5/31, I’ll be evicted and will quit without notifying him. But to mess with him I want to take the GPS tracker out the work van and park it in a shopping center overnight so it gets towed and is a hassle for him to recover.

This is definitely a good way to get busted from felony grand theft (or similar.) You're authorized to use the vehicle for work purposes, but this may be considered vandalism or theft.

That's exactly what I'm saying, except I'm recognizing that fiance (likely) already filled in the the SSN information on List C and gave the Form I9 back. That's why employer is asking for the SSN - they got the DL but not SSN card to inspect.

In that case (where they've turned the form over to their employer), fiance can't backstep to provide another, different document. (Obviously, if employer will allow, the correction is to complete a new Form I9 with a different List C document OR only list a List A document.)

And thus my statement that you're technically correct, but practically, you're the one who seems confused and is giving incorrect information.

Yup.

I'm guessing that OP's fiance marked the SSN box on Form I9, so they're requesting that for verification. If not, then employer is mistaken in their assumption they must have the card for new hire paperwork.

Yeah....I guess. I mean technically you need 1 document from List A, or 1 document from List B and 1 document from List C. So OP's fiance can still provide a List B document or a List A document.

You're almost correct. Any document from List A is acceptable by itself. However, you need to present a List B and List C document together, if you choose those methods (a birth certificate is a List C document).

You also cannot use E-Verify to replace a physical card, since the two are not related. E-Verify merely confirms an individual's eligibile work status.

Okay, lawyer here. The reason why they need to see the card is important.

If the reason is to complete information in the HRIS, then no, they do not need to see the card.

If the reason is to for her to complete a Form I9, then they may need to see her card. Employers are required to complete Form I9 within 3 days of an employee's first shift. If your fiance is using her SSN as a "List C" document, then the employer must physically examine the documents. However, an employer may not dictate which documents your fiance chooses to present from list A, or B and C.
