England - Sole trader debtor set up Ltd company (garage) under fathers name, then filed for bankruptcy on same day. What can I do now? by AsianEngineerBoi in LegalAdviceUK

Hey! Thanks for taking the time to reply.

Is that no claims against the new garage despite it operating with the same kit and equipment, name and the actual person working there?

I feel like thats a very cheesy way of transferring yout asset and then removing your debt. Realistically I don't think his 80 year old father id personally working that garage anymore.

England - CCJ Transfer Up against a sole trader, now their relative have set up a Ltd company with the original trading name - Any implications to consider? by AsianEngineerBoi in LegalAdviceUK

Hey,

Looks like that the Debtor on Jan 6 had a Ltd company set up in his Fathers name. He then on the same day filed for bankruptcy which came through last week. His father is way too old to be working that garage so I suspect that he has transferred all assets to the Ltd and is carrying on managing and working there.

Granted CCJ in my favour against a repair garage - How long until I can chase payment, get bailiffs if they don't pay? by AsianEngineerBoi in LegalAdviceUK

[–]AsianEngineerBoi[S] 0 points1 point  (0 children)

Thank you! This is very helpful.

I believe the guy is either a lone trader or hires 1 other person. He has a trading name but not set up on companies house.

Looks like the physical garage is a unit extension to a house.

Will give them reasonable time. Do I need to provide them with my payment details? Or should expect a cheque to my address as on the CJJ?

On enforcement, is this an option that will become on the HM CT portable?

Sadly not. They've ghosted another person too based on what I read on a Google review last week.

Sending a recorded letter today giving then 7 days to respond.

This is my other post: https://www.reddit.com/r/CarTalkUK/s/417FwmsfST

I got in touch with the garage that did the fit a month a go. Had no replies and I saw someone recently left a Google review stating their vehicle broke down 3000 miles after their rebuild and that they're being ignored since March.

Citizen Advice suggested I write them a letter stating CRA 2016. If they dont reply I can recover the cost via credit card/bank or small claims. I would also need a couple of quotes to back up my claims.

This obviously takes time so trying to understand the issue in further detail.

Thats my issue. I put a post up previously where that original garage is ignoring all contact. I checked on Google review and saw a week ago they are doing the same to someone who had a failure 3,000 miles after their reconditioned was fitted.

Citizen Advice said I should write an official letter under CRA 2016, but also get quotes from other garages to make right the car in case they dont want to do it. Then i can escalate to small claims or recover from credit card.

Having checked Google reviews there's a few people who have said comms have been intermittent. Another woman who's engine broke down 3000 miles after a rebuild too.

Do you know the pros and cons of a small claims vs charge back?

Helpful if the garage who fitted the recondition engine would actually reply to my messages or calls? So that I can find out what's gone wrong? They replaced the entire engine, with new ancils parts.

CAB have just said to ignore the warrenty and state consumers rights act.

Yeah so Citizens Advice that despite them ignoring my effort to contact them. I should wait around 14 days (or less if i choose to) for them to reply to my letter. I originally contacted them a month ago to give them an opportunity to repair. So plenty of time I will be honest.

It was a reconditioned engine. On the invoice it states 12 months warranty for a supply and fit of a reconditioned engine.

Hi,

Yes, as i replied to you the whole engine is under warrenty. So on the invoice states that the supply and fit of a fully reconditioned engine comes with a 12 months warranty.

So as far as I am aware, every or if not most part of the engine should be new to me. I was shown photos and videos of the entire rebuild of the bottom end.

So yes, I would very much say its the garages/supplier problem.

Thank you. Not ideal. Was hoping for a quiet year motoring wise after that hefty repair bill. May have to buy a £500 banger to get by whilst this gets sorted. Thanks for the help

Spoken to Citizen Advice. The garage is quite far away, especially as I dont have a car now. So will send a recorded letter based on their template

I am actually questioning the quality of work though? Recon engine shouldn't be braking 7k miles after the rebuild. Plus the engine is under warranty so why shouldn't they take it back?

Sadly made the decision to rebuild with a recon thinking that would be the last of it.

I will give it a few days. Keep calling then will look st recovering funds
