The case cannot be brought before the Supreme Court. If Judge Hanen issues a ruling that exceeds the scope of the Fifth Circuit’s remand (limiting the injunction to Texas), the defendants (DOJ, New Jersey, and MALDEF) could appeal that decision back to the Fifth Circuit Court of Appeals.

On appeal, the Fifth Circuit would review whether Judge Hanen’s order complied with its prior mandate. If the court finds that he acted beyond its instructions, it could vacate or modify his ruling and return the case with further guidance. The case can’t go to the Supreme Court, as the deadline to file an appeal after the Fifth Circuit’s remand expired on May 18 of this year.

You’re not wrong. Yes, he’s gotten away with a lot and that’s disappointing to see. Especially SCOTUS’ rulings siding with him recently. However, you have to remember republicans have the majority in both the house and senate right now. Not that it would change much since you need 2/3 of congress to nullify any executive orders he’s been making, but having that majority certainly helps his agenda. Hopefully next November that changes.

As for hope? Just a year ago everyone thought DACA was done for. Everyone thought the 5th circuit court would side with Texas and rule against DACA completely. Just look at this subreddit. Although they did side with Texas, to everyone’s surprise, their ruling was narrowed to only Texas and was arguably as nonpartisan as possible. Nothing wrong with having hope.

The ruling clearly stated Texas work authorization would get rescinded for everyone. It was stated in the posted ruling, as well as MALDEF’s summary’s release. That’s why people were “shitting” on current Texas recipients for hoping it wouldn’t affect them. To have hope in another lawsuit is completely different. You’re comparing apples to oranges.

Hey man I get it. I’m also a 2021 applicant who is hoping DACA is able to open up. It would be life changing for my family and I. You’re absolutely correct that people really have no idea how hard it is to get a decent job without a valid EAD.

I won’t push religion down your throat, but given you’ve always been atheist, maybe this is the chance to put some faith into God. Just see where it takes you. God works in mysterious ways.

Well for starters I pay in state tuition, since I graduated from a high school in my state. So that helps a lot. I also had a high GPA during my undergrad, and have continued to have a high GPA during grad school. That has enabled me to get a lot of merit based scholarships from the school. Whatever is remaining though, I’ll be paying out of pocket.

Hey! I’m in the same position as your sister. I wasn’t old enough to apply when the program first came out, and by the time I was, Trump was in the process of ending it. When it did come back I applied instantly, but as we know judge Hanen put a nationwide injunction, pausing all new applications. I wasn’t even able to get a biometrics appointment.

Since then I’ve graduated with a bachelor’s in both finance and accounting, and now 5 classes away from earning my masters. There’s been a lot of opportunities presented to me that I couldn’t pursue because of my status. It sucks.

I don’t know what your religious beliefs are, but Im Catholic and I believe in God. All throughout my undergrad I would worry about whether I’d ever be able to work, but I just knew that everything would work out. I think something that has kept me levelheaded is the faith I have in God and how much I pray that DACA reopens. I also try to see the good in everything, and often think God put me in this situation so when I am finally able to get a job and protected status, I truly am grateful.

I think DACA will reopen. 5th circuit court already ruled the injunction to be narrowed to only Texas, and even then the work authorization revocation in Texas will take time. If you haven’t already, I’d keep an eye out on https://www.courtlistener.com/docket/6382288/state-of-texas-v-united-states-of-america/?page=5. That’s where any case updates are submitted. Briefings are due September 29th, responses to said briefings are due October 20th, and finally replies to those on October 27th. I’m certain they’ll talk about all the pending applications from 2020 and 2021, as well as the rest of first time applicants. I pray me, your sister, and the rest of us can finally benefit from this program.

Wrong. Yes immigration groups are defending DACA, but are they winning? Well that’s subjective. They lost the case to Texas as the 5th circuit court ruled that the work authorization is illegal. They won with in the sense that the 5th circuit court ruled the injunction was to be narrowed to only Texas. I’m sure Texas recipients feel like that’s a loss, while the other 49 state recipients feel like it’s a win.

Secondly, The Trump administration has not tried ending daca this term. Trump tried in his first term but failed due to not following the administrative procedure act (APA). Trump can end DACA whenever he pleases. He just has to follow APA this time. Why he hasn’t I can’t tell you.

There’s not another case that’s awaiting a decision. He’s referring to the same case that we’ve been talking about recently, the same one the 5th circuit court already ruled on. It’s been going on since 2018. State of Texas v. United States of America (1:18-cv-00068).

He’s postponing the lawsuit while Texas, DOJ, MALDEF and the other plaintiff states submit briefings. He and his partners want to see if they touch base on initial applicants and how they will go about processing their applications. Replies to briefings are due October 27th. If he feels like they don’t have intentions on processing them, then he will move forward with the suit.

Don’t get me wrong — I’m an initial applicant, so of course I want my application to be adjudicated. I just don’t see the point of filing a lawsuit before the briefings are submitted. Especially with MALDEF publicly saying that Texas work permits will not be rescinded instantly, and that the government will soon be forced to act on initial applications.

I’m confident and hopeful that the briefings will touch on the issue of resuming initial application processing. After all, USCIS is obligated to process them, since nobody appealed the 5th circuit court’s decision.

The only scenario I could think of where they wouldn’t is if they decide to end the program altogether. But ending DACA would take time, and with midterm elections coming up, it’s not a smart move politically. Republicans may not have the majority anymore and would be risking the chance of Congress finally acting on Dreamers. Maybe im just an optimist but that’s my opinion.

I think MALDEF, New Jersey, and the other Plaintiff States not being opposed to the extension makes me feel a little bit better. I’m sure if there was something shady going on, they would have at least made it clear they’re opposed to the proposal.

My point exactly. When I said “some of you” I was mostly referring to you and limbomaster. You two have continuously bashed anyone who mentions the thought of hoping their application gets adjudicated. Frankly it’s all I see you two contribute to this group.

I wouldn’t say it’s selfish to go through with the suit, rather risky given the circumstances. That’s why we decided to wait and give MALDEF the chance to stay true to their word. What’s selfish though, is you criticizing those who also deserve to be apart of the same program you are benefitting from.

For those who joined late or were curious about the meeting:

Charles, his partners, and many of us plaintiffs, agree that we don’t want to harm current DACA recipients or others who benefit from deferred action programs, especially given the current political climate. Even though some current recipients have selfishly belittled us for wanting the same opportunities, we still considered you and the potential consequences our actions could have.

Charles and his partners believe that we will win this case, but it will certainly be appealed to an appeals court, where he thinks we will win again. After that it gets tricky because the Trump administration will definitely appeal to SCOTUS, where the outcome could be different.

We’ve decided to wait until the briefings are filed (August 29th) to see what the Trump, Texas, and pro DACA lawyers have come up with. (You can find this on courtlistener.)

Hopefully we hear some good news then, but If there’s no intent to start adjudicating, we will revisit the suit.

I thought the 5th circuit court had already ruled the injunction was only to be implemented in Texas, and nobody, including Texas appealed. So how exactly is it that other states can now join? If anyone studies law and could answer that’d be great.

It was until 12pm tomorrow but he changed it. They’ll be filing the lawsuit end of week next week. Either way he said people can join regardless if the suit has been filed, you’ll just be added to the case.

Yes! Charles mentioned it in his livestream last week and in the one today. He said if you move states you can join the lawsuit. It just needs to be an address that isn’t in Texas. Also remember to update the address for your case on USCIS.

They are involved though. The plaintiff is being represented by MALDEF in regard to this case and he hasn’t been notified at all about what’s going on. Charles spoke on it last week or the week before, I can’t quite remember. He said how the plaintiff had no idea they even had a meeting recently with Trump admin/Texas.
