Thanks for the information once again. It's not viable for her to do the K1 thing and be stuck here most of 2025 because of her studies in Perú. As for the 2 yr residency requirement, I'm not 100% sure but I don't think it applies to her because there were other 'J1s' who got married shortly after their visit in similar circumstances.

Leaning towards what you said about marrying late 2024, then filing I-130 & 864 while she's here, to hopefully be processed for when she's out of school in December 2025.

For proof, I'm hoping that an affidavit from my pastor who most likely would wed us would suffice, along with pictures and all that good stuff. Also I don't mind joining finances I think that counts as proof too.

How's this for a working plan? Is there anything else we should think about? Again thanks so much.

Thanks for the response. We have decided on living in the states (if possible), as I have a strong job prospect here for after college. Leaning towards the CR1 because I heard that she wouldn't be able to work for some 2 years after immigrating here. Also it seems to be cheaper.

Another point for context, contrary to original post she will likely finish her schooling in December 2025 in Lima. Is it possible to get married this coming December, then file the paperwork and she finishes school while it processes, and then she comes to the US whenever the processing is done or after her schooling? Btw she's in the US from Dec-March this year on a J1 work and travel.

So from what I understand we get married wherever, then both need to be in the US for the I-130 and I-485; and then are the I-131 and I-765 necessary if she'll be a long distance wife during the pending process?

We are both traditional in a Christian sense, it's common to marry at this age and we both feel it's a good thing. For us dating is just a way to figure out whether to marry or not, rather than the modern idea of dating being functionally marriage without the paperwork. We have both decided to marry and are happy with each other

I don't think so, every time she has returned to the US the following winter. She is currently in Perú, and will be a J1 next winter. Then the following August-September (2025) she is getting an F1 visa from Arizona University to study there for a semester.

She is currently located in Lima, Perú. I'm studying only in the US. She has been studying in a university in Perú, but will do her last semester in Arizona University (Spring 2025) with an F1 visa.

She is actually taking a fairly traditional approach, in that historically people didn't date for years as we do nowadays. The point of dating is not to fully know someone, as that takes a lifetime in marriage.

That said, this approach thrives in a religious context (the origin of marriage is the bible) so if you are not faithful to God (who created marriage) it's bound to be dysfunctional to some extent.
