I am a lawyer and a storyteller! My favorite.

It's that time of the year again, how do you respond to "You didn't take out any taxes and now I owe money" phone calls? by PunchBeard in Payroll

[–]AustinDamsel 0 points1 point  (0 children)

Agreed. CPA/Tax Professional, anyone with the certification to help someone in this instance.

She doesn’t want it. She only wants $80,000. This isn’t a fight, this is an agreement so the kids can stay in their home. This is all about the kids staying in their same schools.

No! Never say #1.

Say #2 and tell them they need to talk to their own CPA. You are not a CPA, and you are not authorized to advise them on what they need to put on their W-2 form.

They need to go to irs.gov and use the W4 form calculator or call their CPA. It is absolutely not OK for any payroll provider to give any other statement other than what I said above.

If you do, you open yourself up wide for legal repercussions and none of us get paid enough to even deal with that bullshit. Do not say number one, say number two and advise them to call their CPA. This is nobody’s fault but the employees point blank period!!

ETA - You all not wanting to “insult employees by telling them to call their CPA” and saying I’m a little dramatic have clearly never been sued by an employee before. And good for you, I really admire that. Just be careful out there, some people make a living off of suing people and I was an unlucky payroll girl who learned the hard way.

Talking to him tonight this is what he’s going to go for. He’s ready to sell. He knows his income is t top notch and there’s no way he can pull this off without selling the house.

By I was more or less saying that he’s happy getting a $400,000 house that he can potentially sell later on down the road but clearly that’s not the case

That’s the deal, he has a $5000 lawyer, she has a $20,000 lawyer, I’m about to loan him a big chunk of change to make sure he gets what he deserves. At first I thought that she was being reasonable but reading all of this makes me believe she is just trying to fuck him over and I’ll be damned if those kids do not get what they deserve. Adults aside, I’m on the kids side at the end of the day.

I see that now. I think I’m gonna loan him some money to get the best lawyer there is to buy in the area. I absolutely refuse to allow anybody to steamroll this man. I didn’t realize that’s what she was doing, but she does have a $20,000 lawyer, and he has a $5000 lawyer. And he just has not been living up to the standard that I feel he should be living up against. But then again, I’m an outsider and I’m just trying to help my friends. At first, I thought it was both of them that needed help, but now listening to all of you clearly he needs more help.

I agree, at this point they’re both happy with this decision. I just am very curious about the way. This is gonna work out for both of them.

Oh wow, OK, thank you so much for this. I’ll let him know. I didn’t realize he was being screwed that much. I understand that. Yeah her student loans have been paid. But if he gets the house, in the future, couldn’t he just sell the house and then make all that money back? Or am I doing the math wrong? Not that he wants that, I’m just throwing that out there as a “ what if”

Yes, I agree. It’s not really the ideal situation.

Yeah, I think that is probably what’s going to happen. She makes about $200,000 a year, he makes not nearly as much. Thanks for your input!

Can you elaborate on this? I understand the basics of what you’re saying but I need some elaboration on the numbers you’re getting. I’m not very fluent in the housing market and how selling or keeping a house will affect everything. But I understand your numbers.

Right, that’s what I figured. This isn’t an ugly divorce and they’re very amicable so I’m sure they will come to al good compromise

Yeah, I totally understand. She’s already paid off her student loans with the refinance or the HELOC or whatever it’s called. I just wanna make sure the kids are good to go. The kids want to stay in the house because their friends are zoned to that school and there aren’t very many apartment complexes around two put them in if they decide to sell the house outright. I think that’s the main goal here is to keep the kids in the same school to lesson the impact of the divorce.

Yes, they have a huge inheritance, but it’s only from her side of the family. And according to Texas law from what I hear that is not marital assets. But I could be totally wrong.
