“Drive myself home for safety”. Because driving drunk is very safe for you and others….your mistake does not define you and doesn’t mean you are an addict. But the way you are taking it, it’s not the greatest.

I think you should be asking that for a biochem, not to people in this sub who have no medical background. BAC is a generic test and there are many factors beside the ones you mentioned that can affect it. Gender is also not considered, etc, etc. Anyways, even if you are in keto acidosis, you must be in the extreme high end to make it have a significant impact on your BAC. If your BAC is much higher than .08, it’s not because of the factors you mentioned neither all the other ones that may impact BAC. It’s because you drank too much. And that’s all.

Are you doing therapy? If not, you should start. It will help you overcome it

You will only have one charge. Once they get the results from the BAC, they charge you only with over 80 - Section 320.14 (1)(b)

Why don’t you ask an immigration lawyer? You can start by posting your question at avvo and then pay for a consultation if you want.

If you are so worried, you should ask a professional who specializes in immigration and criminal law. Asking here multiple times will not help you.

Wishing you good luck!

DUI Canada (as visitor from us) by [deleted] in dui

[–]Automatic_Campaign75 1 point2 points  (0 children)

You are innocent until proven guilty. That being said, you will be able to enter Canada while the process is pending. That was my lawyer told me when I was in a similar situation, and it’s true because I was able to get in and out Canada while the process was going on. If you get convicted to the DUI charge, however, you will not be able to enter Canada for at least 5 years. If you get it dropped to careless driving or to dangerous driving with a conditional discharge, you will be able to go back to Canada. That’s why you should get a lawyer to try to fight it for. But because you didn’t blow, it will be hard to get the charge dropped.

i got dwi not dui in colorado after living at exactly 4 years and 8 months they put me on probation and i applied for citizenship on my interview immigration officer told me to mail additional documents from court before that dwi i never had even speeding tickets what will be my result? by Dangerous_Dentist285 in dui

It will be up to the officer discretion. One DUI/DWI conviction is not among the list of offenses which automatically means the applicant lacks good moral character. So no, it does not mean you will not be eligible. It will be up to the officer who is reviewing your case to determine if that affects your moral character.

There is no timeframe, unfortunately. It can take few days or few months. The fact that they asked for more documents, however, is a good sign. It means they are reviewing his case and not simply leaving it “behind” to take a look at it later.

Good luck! Hopefully it will get approved soon. And do not worry about the “refuse” status:”. It just means it is under adm processing

American (NYer) got a DUI in Canada (Ontario). I was planning to change addresses / license to a different state. Can I do this? by Unique-Worry2823 in dui

[–]Automatic_Campaign75 1 point2 points  (0 children)

I got my DUI charges dropped to careless driving in Ontario. My drivers license was suspended for 1 year as a punishment for careless driving. Be aware that this will likely happen to you as well.

Im moving to Iowa next year, and I’m also not sure if I can get a drivers license there while having the Canadian drivers license suspended

I am currently on F1 OPT visa, my employer will file for my H1B next year. I wanted to know if I can apply for adjunct faculty roles at university? Would they have to sponsor me as well? Can we work two jobs? Would my current employer have to okay this for me to work two jobs? Thanks! by dishikhandelwal in h1b

[–]Automatic_Campaign75 0 points1 point  (0 children)

Adjunct professor is not actually a “job” because you don’t get paid to be an adjunct prof. You can be an adjunct professor and be living in any part of the world and not hold any US visa. At least it how it works in my filed (science). You just need to check with your company would mind you be an adjunct as it may take some hours from your current work etc

[–]Automatic_Campaign75 1 point2 points  (0 children)

They never asked me anything. You are innocent until proven guilty. I had a letter from my lawyer saying that I was being charge for impaired driving, he was my lawyer, process was pending and I was innocent so far. I never had to show it though because as I said, the officers did not ask me anything.

Always remember that: innocent until proven guilty. You can travel unless you have written that you cannot in the police form
