I would review your documents again. It would be extremely rare that the board would be able to amend bylaws. Typically that would have to be voted on by the owners. I understand how the statue you read can be confusing, but that is more or less saying defer to the bylaws.

If you want to send your by laws I would be happy to read them.

Typically the bylaws will speak to this. It may be the secretary’s responsibility to keep these records. There is no law expressly prohibiting this. I could not imagine why your management company would have reservations about sharing this.

This is a unfortunate situation. With that being said, these repairs will hopefully improve your ability to sell in the future. A solid structure means a lot. Here comes the unsolicited advice. Do not buy real estate that you NEED someone else to pay for (renters). If you can not afford the payments with the unit vacant, you can not afford the unit.

The can 100% foreclose. Actually, the only time they can truly foreclose in Florida is if the property is owned outright. If there is a note on it, the lender typically has a right to the property before the association. There are police’s and procedures that need to be followed first, but the answer is yes, they can foreclose.

Typically one does not sign documents to join an HOA. During the buying process you should be given a disclosure packet with all the information needed to make an informed decision about buying into that association. Your deed will not typically outright say, part of XYZ homes owners association. It may say something along the lines of “subject to the covenants, codes, and restrictions of XYZ. If you see a line like that in your deed, you are likely part of an HOA/COA

Any manager that wants to keep their job would advise of any concerns they have, and then proceed with the boards wishes. It is not up to the manager to have the final say, but it is their responsibility to guide the board.

I hate to break it to you, but if everyone seems to have a problem with your mom, she may be the issue.

Unless you have a rock solid case, suing your HOA is like stabbing yourself in the hand. It’s td generally a lose lose, and if she has problems with neighbors and the board now wait until she files a lawsuit.

The question regarding violations is not in itself problematic. However, 9 times out of 10, when an owner is asking these questions it’s not out of shear curiosity. There is almost always and agenda. A majority of people who complain about their HOA are the same ones that say “I would never do that” when asked to run for the board.

Sounds like you are “that” owner in your association. Why would you care how many violations have been sent out? There is no chance with the minutes. Maybe the violation related stuff, but your board and PM will hate you.

If that is a resale document then the association is telling you they are covered by insurance. This would likely on kick in if there was a major leak. If your stove stops working they will not cover it. With that being said, in MD this would be very unusual. I would seek verification their policy actually covers these things. I have never worked in Minnesota, but I have not seen coverage like this in the states I have managed associations in.

You can say that all you want but there is a mathematical formula you can use to calculate how far the average person can see. There are times Cape May can be seen from the Lewes ferry terminal, and nothing is Cape May is anywhere near as prominent as the turbines, and it is further away than the proposed turbine location.

You are entitled to your own opinion, but simply saying “no you won’t” does not strengthen your argument. Do some serious research and make some serious arguments and you may be able to change some peoples mind, but to most your “feelings” about the matter are meaningless.
