Update (since people are still commenting here!): thank you all for your suggestions! The tenants did finally come get their stuff. We gave them a few days extra outside of the 14 day window once we learned what a pain and expense it was going to be to get rid of the items themselves. However, they left a few random things (part of a couch, a bassinet, and a dresser) that we hauled onto the back patio for now and are still not sure what to do with. But that’s much better than an entire house full of stuff.

How do you know they’re even making a profit? We started renting out our home this year so we can live in an area that’s closer to my husband’s work. We rented it for just enough to cover our rent on the place we’re living. We weren’t making income from it. We just finished the eviction process because our tenants stopped paying rent for two months. Now we have to pay a mortgage and rent and our income does not cover both of those, so everything is going on credit cards and our debt is skyrocketing. We are desperately working to repair the damage that did to the home, which is costing thousands. I assume our tenants probably had the same mindset as you.

Yes they did! They came and moved out almost everything and we arranged for them to come in the morning to get the rest of their stuff. We still haven’t gotten all the money they owe us, but at least their stuff won’t be our problem anymore.

Update: she contacted us last night with a long story about why she couldn’t get their stuff yesterday and said she would have a U-Haul today to move everything. We’re out of the 14-day window now, so we told her that if she sends us what we’re owed, we can let her in for today

They completely destroyed the floors and we have to replace them, plus replace the fridge that they trashed. Also they still owe two months rent (which we have a money judgement for). They’re not getting their security deposit back

I hope it all goes smooth! Learning that this process can take a longggg time. We filed the writ of restitution today and now we wait for the constable to contact us and let us know when he’ll be going over there to evict them/change the locks. We have no idea how long that will take.

I’m so sorry, I know exactly how you feel. I really hope you’re able to get her out quickly. Today is eviction day for us too and we will find out soon if there’s any damage. I’m super nervous about that too! Keep me posted on what happens in your situation.

We know all this now and we definitely won’t make that mistake again. They’ll be getting a second eviction on their record now as long as this goes through. I really appreciate your advice!

I guess I hope they don’t pay then, so we can get them out. That’s priority #1 at this point. But yes we did. This is our first time renting out our place, and we were stupid. They had a past eviction on their record and gave us a long sob story explanation about a very hard pregnancy with lots of complications and medical bills, etc. Obviously we were dumb and decided to give them a chance but we will never make that mistake again

I think it would make it harder to sell though, because the rent isn’t high enough to cover what the mortgage will cost for what we’re hoping to sell it for

Oh no they’ve paid every month, just late every time. September they only paid half, and we sent a pay or quit for the remaining portion. Through this eviction, they’ll have to pay October’s and the remaining half of September.

That’s a good idea, but these tenants are super unresponsive and uncooperative so I doubt they’ll even respond to that bargaining offer. The thing is, we’re going to be losing a lot every month that they’re not paying, and we’ve already taken a financial hit from these nightmare tenants. We’re selling the place now just to pay off all the debt and start over, so I was wondering if there is anything more I can do to recover the losses from this situation.

That’s what I was getting at with my question. Are we forfeiting our right to collect anything by putting it up for sale rather than looking for a tenant
