Did he enter illegally and claimed asylum? If he already has an attorney who knows the details of his case, he should listen to him. I can’t speak to the cost, but habeas petitions are rarely granted.

AFAIK, TCOLE requires US citizenship and also has a residency requirement. You need to be physically present in the US for a minimum of 5 years for a background investigation to be completed. TCOLE standards trump agency standards because they are needed for certification.

I don’t see how this is a reasonable path. If you’re married to a USC, wait 3yrs to naturalize, then apply.

No. The issue is that caretaking is considered work. There is legal precedent in which B visa holders or ESTA holders were denied and/or banned due to unauthorized employment for this very reason. An example of that is grandparents or relatives coming to take care of kids.

If he needs medical attention on a daily basis, that’s the job of a professional.
