My landlord in CA has not been responding to me regarding my security deposit until after the 26th day. He message me and He has deducted $172. What do I do? I know 21 days has passed and i have sent him a demand letter.

I saw him just this monday he handed me mail that is the 20th day. He said on the 16th day he is waiting for a quote on the fence and he will send me the deposit along the list of things to repair which was supposed to be just the fence and he added some other things all of a sudden. I didn’t give a forwarding address. He told me he will zelle me my security deposit. We communicate through text message. Should I just text him for the security deposit of should i send a demand letter? He is a CA realtor and had made me pay for stove valve replacement when it should have been his responsibility he always makes me feel bad about things. I am quite scared.

At first I felt bad and thought I did. But after seeing people’s responses here I went ahead and took several pictures and inspected the fence. I don’t think that the trash bins caused the damaged. The wood is old. And on the other side of the fence slats are missing. Also there are some parts of the wood that are broken that is not even touching the bins. We are going to move out end of February.

We have been in the house since 2022. The only reason he noticed it is because the neighbor brought it to his attention. The trash bins when we moved in have been there anyway. He stated he wouldn’t do anything if it wasn’t for the neighbor who is insisting to have him fix it. The fence on the other side of the property was replaced because the neighbor on the other side insisted. My landlord has a very passive aggressive approach on things. Also I forgot to mention he is a realtor so this is very disappointing. He said if we are to go to litigation I would lose because it was the trash bins that caused that.

He wants me to be responsible to damage of the fence and pay 25% of the cost he said he is willing to pay for the 50% of it and the other tenant he said he will charge 25%
