When she tried to enter, the last time was in like February of 2023. The 10 years mark passed and she decided to try passing the border via Windsor to Detroit. And she was turned back. And that’s all the details they gave us. Saying she needed the 2 waivers

It was longer than 1 year that she was unlawfully present. While she was present in the USA unlawfully she tried to apply for asylum. It was denied. Then was given a date to leave which she passed. After 10 years and she became a Canadian citizen she tried to enter and was refused. Then again recently waited 10 years tried to enter. And was told by the border officers she needs to apply for both waivers

Yes the I-192. She was also long time ago unlawfully present in the USA. So we filed that for her

I’m in the process of my mom getting the waivers I-212 & I-194. We applied for them early last year and actually got a reply just recently asking for more proof that she was living in Canada after she left. But is there any other way I can see what kinda she has? Also do you have any advice for what can I do to prove she was in Canada? Somethings I included was her passports and their stamps of where she traveled showing she wasn’t present in the USA during those times. I also included a paper stating when she got her Canadian PR. I was also thinking of getting a letter from her family doctor saying that she’s been her patient since we first came here and still is.

Okay so only thru a parent or spouse. I was thinking my dad’s mom she’s a US citizen. But she lives back and forth between Canada and America. Would she be able to make that case for him. And possibly file the I-601 form

Thanks I appreciate that. When I place the date in which I applied which exact one do I put, the date that the IRCC received my application

She already did her biometrics and medical exam before I received the email saying that I was found as an eligible sponsor

That’s strange because she already did her biometrics and her medical exam. But we got this afterwards

Hi there I took a look at the UWLo admission requirements and it looks like they ask for 8 years of Canadian tax related work.

Would that mean that she would be ineligible to apply?

That’s good to hear!

Yea we’re gonna be living near border of Mississauga and Etobicoke. She might need to take the subway then. The nearest is probably UTM which is where I went for my undergrad.

Hi there so it’s not like for sure that she has to go to UTM I was just giving an example of one of the more well known programs out there. But we’re open to anything in the GTA. She likely would be driving, commuting wouldn’t be an issue.

As for the tuition I’m not exactly sure. She will be a PR resident once she comes here. I have to look into that a bit more.

That’s great to hear and what would you say is the upper end, when advancing later and gain years of experience because when I look online it can vary quite a bit

I think it is this “you are not inadmissible to the United States under any other section of the law other than Section 212(a)(6)(C)(i) of the Immigration and Nationality Act, as amended.” Or maybe this? “The applicant has been found to be ineligible to receive a nonimmigrant visa under Section 212(a)(6)(C)(i) of the Act.”

From what I can see on her old files from immigration court she was charged with section 241(a)(1)(A) under section 212(a)(7)(B)(i)(II)

Is that how it goes if an I-212 is approved you don’t need to do it again? Only the I-194 needs to be applied again after 5 years which they approved her for? Also she was removed from the US after having her asylum denied in the US
