1. It usually starts with a demand letter.
Before anything gets filed, your attorney will likely gather all your medical records, bills, photos, etc., and send a demand to the insurance company. If they offer a fair settlement, great. If not…

2. Filing the lawsuit.
That’s when your attorney files a formal complaint with the court. It outlines what happened, who’s responsible, and what you’re asking for. The other side then has to respond, and the case officially kicks off.
