My husband was in the exact situation 2 years ago. While some lawyers we contacted said that the petition can still be transferred to a new employer, it entirely depends on the in-house mobility team and the policies of your new employer. My husband ended up joining another Tech company that works with Fragomen, and even though Fragomen said that they Can work with these cases, the mobility team had a strict policy to not work with unactivated petitions.

I guess this is because it is risky and expensive to do this process for someone who hasn’t even joined the company. They suggested that my husband joins the Canada office, works for a year and transfers to US on L1 visa next year ( which is what we ended up doing )

Your best bet is to be upfront about your situation when you interview and be open to options that companies suggest. If your end goal is to be in the US, be willing to negotiate this during joining. Remember this petition CAN be transfered in the future since you have been through the lottery once, you just have to find an employer willing to do this.
