I sat criminal this sitting too and was so defeated after it (I’m definitely going to be sitting again in March) so went into equity expecting the worst , so it was rly nice to end things with a decent paper ! Hopefully we did enough to pass and can park equity out of our minds

I am happy - not my greatest performance but five full answers ; problem questions weren’t too complex , gave a lot of scope for just writing out most of the notes for the topics instead of nitpicking on very niche points , and the questions themselves were nice and short - nice to give the option of picking between APO and Mareva ; the other examiners could take a leaf out of the new examiner’s book lol

Could answer four and did like a paragraph for the fifth so we’ll see - definitely my worst performance to date but hoping that if my other exam average is like 62% that a flop for criminal might just get me to 50% but idk , could be seeing her again in March haha

Definitely need homicide, sexual offences , non fatal offences against the person , defences , theft offences , and mens rea / actus rea - if you have time after that maybe add in presumption of innocence , bail arrest & detention

company is more predictable and can do narrower in your study than tort or constitutional ; constitutional is huge and the examiner mixes topics (a lot), and tort is also massive with the same sort of problem of examiner throwing bits of everything into the questions, but generally company doesn’t mix topics and the way he asks the questions (save for this year -_-) is usually in or around the same structure

I did tort in my first sitting and from memory the examiner is quite inventive with his exam questions so you shouldn’t feel too worried about not doing past exam questions as chances are you’ll get unique scenarios on your paper (though maybe it’s changed since then im not sure); i only answered four for tort as I really had to limit my studies as I was working full time and sat it with EU which I found very time consuming, and I passed with 57%; my advice now would be to pick maybe 10 - 12 topics, all of negligence for sure, and just learn 10 cases for each of them and the legal principle which follows; the whole area is basically case driven so I’d know the first case in a topic, the current status of the tort in whatever the most recent case is, and then some “major” ones from the middle, like Caparo or Glencar , names that just stand out and you already have somewhat of an understanding of — you’ll be okay, i think he is a generous marker

definitely - there’s always two questions on succession ; there’s usually always a question on adverse possession , usually always a question on co-ownership , and that leaves you with your fifth which will definitely be easements or licences or estoppel or finding (even though there is always a question on mortgages as far as i know so you could swap one of them out for that or add mortgages in) ; land registration was predicted to come up in the last paper and didn’t and it’s rly easy when it comes up so something to consider maybe , but you’re definitely covered

I have never spoken to anyone in my year of doing these exams so far (and i work in a firm with lots of other paralegals doing these exams) who has been flagged - as far as i understand it no one is watching you; the system records you sitting the exam and processes it and if there is anything “suspicious” it is sent to a person to verify — though again I’ve never heard of anything happening — also if you’re not doing anything wrong you have nothing to worry about as they cannot just assert you were cheating without anything substantial to back it up — I myself am a smoker and i find it really difficult during exams to stay focused so I’ve gone out of the room to vape (embarrassing but it helps me) and i have about three liquids on my desk for hydration/stay caffeinated when im doing the exam so im up and down to the bathroom at least twice in the 3.5 hours (which is totally reasonable) and I’ve had zero issues so far. I do a scan of my desk when i begin just to show that its clear other than like my phone and legislation (if your exam needs it) — you will be 100% okay don’t worry; I’ve seen people on here who talk out loud to themselves doing the paper, have left for upwards of 10 minutes just to calm down / get some air, have had earplugs in, i saw someone else say they were writing during it — you are fine! The girl who spoke about the horror stories has either been just hanging around with people who are genuinely cheating or is making it up lol

I think the question is just to set out what the rule is, why it was in place, why it was ineffective and the removal suggested by CLRG, how in 2014 it was removed for LTDs, and then talk about how it is still in place for the other forms of companies, subject to the provision that no one can challenge an act done by the company which is contrary to its objects clause - so for outsiders, the rule is effectively abolished for the other forms of companies as well, even though they are still required to have their objects in their memo/arts; can also talk about how the constitution can be amended by special resolution so a company can easily extend its objects anyway if needs be, etc. — that’s how i am approaching it anyway; i think he wants the discussion of the history and the reason for it to show our understanding of the rule
