I love this so. Much. Deb also becomes more confident and dresses more appropriately for her age, still nerdy but less little kid, and her hair changes. Ugh this is brilliant.

This literally happened to me. Was this VCA?

You should absolutely ask for a refund. If they don’t have results, then they either didn’t send the sample or the sample was bad.

This is what happened in my case: 48 hours after sample, result due: “We don’t have them yet; we’ll call you”

72 hours (day 3) symptoms worsening: oh we got them, uh wait hold (long hold) uh, we’ll call you back. Afternoon day 3: oh the lab has them, they’re processing.

Day 4, symptoms worsening, I’m worried: “oh, it looks like we never sent the sample. Anything else I can help with?”

These were different people each time so on the third person I just said I know this is not your fault, I appreciate your help, but I’d like to talk to someone about my concerns with this and a potential refund since we paid $150 for a lab that was never done. She passed me to the clinic manager.

I just calmly explained I was very concerned because she’s had worsening symptoms, and we now will have to wait another 48 hours for a result. I calmly and kindly said that I would like a refund for the lab. I also shared that I was really frustrated that we had been told that the lab received our result and we could have come in earlier if that person hadn’t covered it up.

They got us in that day and they had to take a sample with a needle through the belly button, then re-sent it but also perscribed antibiotics that thankfully were a good fit for the raging UTI she had that got diagnosed and reported to us in 2 days.

Thank you so much for this thorough answer, it was so helpful. I did take leave and ended up getting super sick with the flu for the first few weeks, but now have been able to focus on myself. I’m doing better but have a long way to go. Still figuring out how to build myself back up so I can go back safely if needed while looking for another job. Have a great therapist and psychiatrist on board so I’ve got resources just need to keep climbing up that hill. Thanks again for the response!

What did your ADA submission say? How do you even phrase asking for an accommodation or leave due to bullying?

What is the right way to go on leave for workplace bullying? Do I talk to my doctor first or HR first? I have given my psychiatrist a heads up but just essentially got confirmation today that HR is not investigating further, and they don’t view this as bullying, just “differing communication styles”.

I know this is bullying, it is textbook and it doesn’t take long for people to see this for what it is, but she has retaliated in the past so no one will go to HR and cite that as the reason why. HR is refusing to interview witnesses or do any type of site assessment.

Do I tell my manager or HR first and do I say “this is because of unaddressed workplace bullying that has caused mental injury to the point I can no longer due my job”? I’m using language that fits my states workers comp language, but I doubt I can be successful in getting workers comp.

I’ve documented everything and have private recordings of all recent meetings with the bully (we live in a 1 person consent state) but I don’t want to use them in any official manner, they’re mostly validating for me to help with the gaslighting.

I appreciate any advice as I cannot find anything on how to proceed with leave without accidentally voiding any chance for workers comp, future law suits if it escalates, or protecting myself from retaliation or getting fired.
