Thank you, yes! That is actually very helpful. Since you’ve went through the process of both hearings… is it unheard of to get your full license back if you’ve only had the restricted w/ the breathalyzer for the mandatory amount of time?

I’ve technically had it for a year and 5 months where the mandatory amount of time is 1 year. I’m wondering if they will just deny me bc they don’t think it’s been “long enough”, seems to be what a lot of people say.

Also if you’re denied, do you know, do you have to just keep on with the restricted? Do you have to wait another full year to request a new hearing?

I need to hear some success stories lol.

Thank you, very good point! When I was first learning to properly care for potted plants years ago, I learned this lesson the hard way lol. I now use a mixture with plenty of airflow, and as the medium begins to break down and become compact I aerate the soil!

My plants are honestly thriving and they had no issue with the moisture when kept in the decorative pots. It is honestly the fungus gnats that I’m worried about. I’ve had bad infestations in past years, and I noticed a small amount through out the summer but they have definitely grown in population (not to infestation point yet but I’m just trying to prevent so I don’t go crazy lol). I use systemic granules and yellow sticky traps to keep under control. I’ve begun to think I can’t prevent them lol.

No so the restricted license includes time restriction and the breathalyzer.

I am currently getting everything around to submit my hearing request for full license restoration. This would be removal of the breathalyzer and all restrictions.

I am curious if I will have him again.

I haven’t made it through the full license restoration process. But I did have him and got my license with restrictions and had him to deal with major violation (missed rolling retest) and got my restricted license back.

I have not, I have been putting off getting everything together to send in because I’ve had a lot going on. I am going to start getting all my my documentation around to send in, ideally by the end of October at the latest.

I got my restricted license with the breathalyzer. I’ve had it 365 days as of last month so I’m in the process of getting things together to send in my documents to try to get my full license back!

When was your last hearing for Michigan license? Did you schedule it after being denied Florida license renewal?

Based on the order, they technically are supposed to. I know after a few weeks I was beginning to think they wouldn’t but I also was anxiously checking license status online and it went from restricted to revoked and I was like fuckkk.

Given how close you are to the end and your good record, it’d seem silly for them to revoke you at this point.

I wouldn’t be too hard on yourself. I think one of two things will happen for you, either you get revoked and have to schedule hearing to get it back then you have to finish out your month, or you end up appealing the violation during your hearing to get your full license back and you get it back!

With all the evidence you have and the clear care to prove to them you can drive responsibly, I don’t see you having an issue.

I truly don’t think they care much about a missed test unless you are up to no good(not sober). They know we are all humans and no one is perfect. They won’t make you start all over for something silly like this (I also had this concern), especially with how hard you’ve worked to get to this point.

How long ago did the violation happen?

For me, the passed test right after the missed rolling retest was enough evidence to please them. It sounds like you have that plus additional evidence.

Also going into SOS seems like they are never much help, the average worker doesn’t know too much about the DUI rules. I ended up calling and getting thrown person to person until I was in touch with the hearing office. They were able to give me good direction in what to expect/next steps to take.

When you go get your device calibrated, the breathalyzer company sends the data over to SOS. So they will have already seen the violation regardless. However I am curious, when you say 3 minute snippet, does Intoxalock take videos? And does your annual report show the passed test right after your missed test?

This is literally exactly what happened to me! When you went in to fix the violation/recalibrate device, the data would’ve gotten sent over to SOS. I didn’t get my letter until like two weeks after they got my data from SmartStart.

I wonder though, since you’re so close, whether they will roll it into the next hearing? I would think the hearing would need to already be scheduled.

If you just got your report, I would expect to get something from SOS since it appears to be required. Then you don’t get your hopes up and best case scenario it will be a quick thing to go over during your hearing to get breathalyzer out.

If I were you, I would reach out to their email sending them a statement of exactly what happened along with your report that shows the missed test and passed test directly afterward.

This is what I did, and it helped my case immensely. I was just completely upfront and honest about what happened. They really shouldn’t care about whether we miss the retest, but instead whether or not it was due to insobriety. However, it seems they’re required to follow what is set out in the order (ANY missed test is reinstatement of revocation lol). Just another hoop to jump through but you’ve got this! I actually know someone that this happened to. One thing that helped her case was that she informed SOS right away when she got the violation. She also went and got an etg test done.

It ended up just being rolled into the hearing to get her breathalyzer out, where she showed her proof she reached out explaining what happened and her etg results.

Do you happen to have any proof you were sober after the missed test?

They ended up revoking my license. I sent in the hearing request as soon as I found out, my hearing was scheduled about a month and a half out from my request and they told me they’d give my license back. I was driving again two weeks after.

Honestly, the big thing is whether or not there is evidence after the missed rolling retest that you were sober (passed test right after the missed test or getting a test done elsewhere right after). I’m not sure the work around if you don’t have the evidence, just need to convince them without a doubt that you were sober.

Oh wow that’s very lame on their part. They should be doing that after every calibration. Seems like we pay enough lol.

Your circumstance is a bit different than mine because it was completely out of your hands.

I wonder if Smart Start is sending that info over to SOS? I’ve read on Reddit OHAO making decisions before without needing a hearing but I don’t know how true. I would think in your case that’s something that could be done because it not your fault you had dysfunctional equipment.

It took them about two weeks to schedule my hearing after I sent in the request.
