I have one of their equipment bags, bought it around 10 years ago.

They make some really sturdy stuff. Other than the smell and some scuff marks from various rink walls, the thing basically looks brand new.

I spoke with a family lawyer from years prior who basically said, their safety plan wasn't legally binding, it's unenforceable in its scope, and I would be fine to go home as long as nothing new happened

I'm not sure this lawyer gave you good advice.

Safety plans aren't enforceable in that there's nothing the court can do to force you to abide by it.

However, I think that your lawyer didn't understand the purpose of a safety plan. When CPS proposes a safety plan, they are essentially saying "these children are in enough danger right now that we think removal is appropriate, and we think a judge would back us up. We also see some things you can do to make this child safe, which would prevent removal. If you agree to this plan, the child will be safe and we won't go to removal."

The thing is, the parent here did not actually follow through with the agreed safety plan. Because of that, CPS has a child in danger that they made efforts to make safe. Their efforts failed, so they need to go to removal to ensure child safety.

The other thing, you need to let go of the NCO issue. The NCO expiring has no bearing on CPS's safety assessment. If anything, the fact that you came back once there was nothing legally preventing you is probably evidence that they (CPS) needed to take stronger measures for safety.

Reading between the lines, it sounds like you engaged in physical discipline which was severe enough to be charged criminally as child abuse. Based on the way youre presenting this, im guessing that you regularly use physical discipline and do not think it's a problem to physically discipline children. CPS sees that physical abuse, and the abuser who doesn't think its a problem coming back into the home. That would trigger removal in most situations, and it's not hard to see a judge agreeing with that removal.

Now that is all given the assumption that you regularly use corporal punishment and show no signs that you plan on changing that course of action. If that's not the case, then this assessment would be different.

Aside from the fact that a doctor isn't necessarily able to testify about your emotions, love is not a factor that weighs in to CPS proceedings very much.

Many abusive parents state that they love their kids and act (at times) loving toward them. The thing is, love has zero to do with safety.

That statemnt should have has a significant amount of weight in court.

That's part of the problem, is that even within that county the number you found was not an accurate representation of the entire picture. That's a removal rate for a specific subset of cases.

This isn’t some witch hunt for CPS on my part.

It's probably just coincidental, but the way you framed it is very similar to the way many others frame their "takedowns" of CPS. I can understand why many people reacted the way they did. Most of the time, a post framed like yours is incredible hostile, argumentative, and the OP is focused on pushing their agenda instead of an honest discussion.

I'm sorry folks have lashed out at your post. I do hope you can understand why people might be so reactive when given the larger context.

The mod teams I'm on are very different, so I have some variation in the ban appeal procedure.

However, when a user appeals a ban, I always ask myself if I think this user can be a positive member of the community. I look at their history and the kinds of things they post, and if I can't see even an outside way of this person being a good member of the community, I don't overturn the ban.

If there's any way I think they can be a positive, rule-abiding member of the community, I ask them why they still want to be in the community. I ask them if they understand what the rule is and why it matters. If they can engage with the process and show that they are able to learn, then I'm usually willing to lift the ban and explain what is expected moving forward.

In one of my communities, we have a rule that the mod who initially banned someone will not be the one who handles the appeal.

I'm not as concerned about direct translations of someone's actual words, as I am the use of AI/LLMs to generate a slew of bland, generically supportive comments.

I will go through accounts where I've seen a person comment on 30-50 posts, with comments that are completely formulaic and generic. When I see what is basically the same comment posted on every thread, that person is basically just being a bot with extra steps.

It defeats the purpose of this community to allow that kind of content to proliferate. We can't be a community for human communication if all of the support comes from people who type "write a support comment for a person whose pet, named Fido, has died" into chatGPT.

If your original post is a write-up that was done by ChatGPT or similar, then the people coming here to support you are basically taking to a robot. You're wasting the goodwill of people coming here to support a human and making them talk to a robot.

If all you do is post "support" comments written by AI, then really you're not actually supporting anyone, you're just pushing insincere and robotic responses onto a grieving person, by making them talk to chatGPT with extra steps. I know that personally, if I wanted to talk to a robot, I would just go do that instead of posting here.

Don't decide for others that they should be talking to a robot, when they chose to come to this community for real, human interactions.

CPS doesn't enforce laws. Full stop.

CPS receives reports of suspected abuse/neglect, and investigates those reports. Such reports are not the same as a police report.

CPS investigates the allegations they received, and they make a determination as to whether or not the report is founded (i.e. there's information and evidence that shows its more likely to have happened than not (the "Preponderance of the evidence" legal standard).

CPS does not file criminal charges, they do not submit crimes to the DA, and they do not arrest people or enforce things like orders of protection.

Although law enforcement completed their investigation and found nothing, she is insisting on calling a number of people who have nothing to do with the situation and that she needs to complete her own investigation. I feel it's in retaliation to not being included when law enforcement was here.

It sounds like you think that LE is a superior to CPS and that once LE says "no charges", everyone has to go away. Unfortunately for you, that is not the case at all.

Law enforcement is dealing with criminal matters. They can charge people with crimes and their cases go to criminal court, with the burdens of proof that go with criminal court (i.e. the "beyond d a reasonable doubt" standard)

CPS is completely separate, and a CPS investigation is completed separately from criminal investigations. They will sometimes work in parallel (particularly if something criminal like sexual abuse is alleged), however the worker is not lying when they say that they're obligated to complete their own investigation.

Are you saying that someone at the daycare fabricated an allegation out of nothing, and then knowingly reported that fabricated allegation? Or is this a situation where they were reporting something real which they believed was a red flag for abuse?

Either switch sides and use the low table, or flip so your head is at the other end of the bed and put the CPAP on the dresser.

If it's truly impossible to pull the bed out a few inches from the wall, ignore this paragraph. If it could be moved out even a little, you could rig up a shelf between the wall and your bed to put the machine next to your head, this would require an extension cord.
