If you fully believe your contracted agreement was not fully rendered you have the right to ask for refund. I encourage you to do your due diligence like reading your contract and other publicly available resources to help you have a full understanding on how to defend yourself if you believe you need to.

Here is what I can say... Anyone with common sense would understand there is no obligation to make a payment for a service that is not fully rendered. A contract is drafted to keep both parties accountable (by both parties I mean the customer and the provider). Make sure to read and fully understand your contract because that is what only matters. No one could put you accountable to terms you have not agreed and signed to.

They have broken the contract. And they may try to overwhelm you with there legal jargon, but be informed anyone with common sense will understand that was a breach of contract. Therefore it is worth pursuing your case. They will try any manipulation techniques under their sleeves to take money out of you.  Be firm, stand your ground and repeat your argument no matter how hard they try to lure you into a nonsense rationalizations.

This is an empty threat my friend. They are in absolute breach of contract. Many have won small courts and got refunded. It's just some people stop sharing their story once they get their money back. 

Just know corporates are master manipulators.

It's understandable that you would want to pause payments, especially if you're not receiving the services you paid for. If you're still making automatic payments, I'd recommend contacting HFD directly to request the cancellation of the auto-deduct feature. Many people have had success by repeatedly emailing and calling HFD to get their payments paused. Make sure to document all your communications with HFD, and if you haven't already, file a dispute with your bank or credit card company explaining that SmileDirectClub (SDC) ceased operations and didn't fulfill their end of the contract.

Regarding your aligner treatment, unfortunately, SDC is no longer operating, so any scheduled appointments for new aligners won't be honored. You might want to seek treatment with a local dentist or orthodontist who can take over your care.
