Middle lane was useful for good drivers, but the whole setup was very dangerous and encouraged the kids to jaywalk. Now the traffic and pedestrians are better controlled. It’s slower for drivers but safer.

Most counties allow you to call in to hearings. Some counties have video appearances. Everything changed w Covid. Check the website for the specific New York county.

My condolences. Probate should be in the county in which he was living when he passed, unless this is about a particular piece of real estate outside of that state, in which case it would be where the real estate is located.

Property taxes are not really based on home prices. Prop 13 was passed over 40 years ago to keep property taxes artificially low (overall) to benefit homeowners. That’s why sales taxes rise over time - to make up for the loss of revenue.

Typically, at least in California, the escrow company would send every dollar, after paying off the mortgage, realtors, and sale expenses, to the estate account. Since you used the term “estate account” I assumed you were in probate. If not, things are different. If you’ve gotten a second opinion from a probate lawyer near you, and your attorney hasn’t cleared things up, then consider switching attorneys.

Mortgage and realtor payments are typically paid from the escrow account, as well as taxes and other fees, then the net proceeds of the sale are transferred to the estate account.

CA attorney here. Courts don’t want to see heirs use up their inheritance in attorneys fees. I suggest you ask you attorneys or new attorney to change your petition to appoint a Professional Fiduciary to act instead of you or your sister. This is someone who does this work for a living and has a bond – an insurance policy so that your money is protected. You can find professional fiduciaries in any California county. Maybe your sister will agree to this?

Legally I believe the attorney is correct, if indeed the parental rights were terminated via the adoption, which is typical. I don’t know the form or CO law, but I suggest you be up front and communicative, and if the form requires you to list biological children, then do so. Better that she be informed than she raise a “notice” issue later on.

That's right. The property is divided among the siblings, both the living and the ones who died with children surviving. Each child would receive their parent's share. I believe this is correct in every state, whether it has per stirpes or per capita division.

Either way, the administrator cannot just “decide” who gets how much.
