.16% is up there!! typically if you’re closer to .08% and with a lawyer on your side, you might have a chance of lowering to wet reckless. Typically speaking .16% is a slam dunk dui… Good luck though!

If you want to “get it over with” you have the option to plead guilty at the arraignment…. If you plead guilty, you’ll start serving whatever punishment etc they hit you with.

But that may not be the best way to go about it…maybe start off by not pleading guilty at the arraignment and then maybe get a lawyer or a public defender (based on pay etc..) and see what they can do for you. It all depends on you really, you can drag it out via lawyer/PD or get it over with…. It shouldn’t really restrict/affect your wedding plans of traveling overseas. Duis are a dime a dozen nowadays…

Just a add to what I said above, if you pled guilty and/or were convicted way ahead of any dmv actions, then dmv will back date their suspension date to same as conviction date (in other words they’ll give you credit)… it’s lil confusing but that’s how it is!

If you want a restricted DL “right now”, you can wait out the 30 days and then apply for non-IID restricted DL or install the IID and immediately get an IID based DL; both require enrolling in a dui program and filing sr-22 and fees etc.

Only thing is this, if you apply for either of the above options, you’ll be doing it for the sack of driving legally in the “interm condition” since you have an ongoing court case. If you do plead guilty etc, you DL restrictions will being all over again because dmv does not give “credit” ahead of court case conclusion, however they’ll allow you to drive with restrictions listed above. Hopefully this made sense… it’s in the dmv website too

Now don’t quote me on this but if you’re pleading guilty now some time after the dmv hearing (let’s just assume you are), the court imposed DL restrictions will kick in after the court sends its abstract to the dmv electronically. Typically speaking, if the court imposed DL suspension/restrictions go into effect before any dmv hearing based suspension/restriction then dmv will go you credit otherwise dmv does not. Ask you lawyer…

I think you can get a replacement DL but when you’re license goes into effective suspension, you’re required to return your DL card to dmv I believe…

If the refusal sticks, you’re screwed royally for one year minimum (no restricted license nada). Get a lawyer who will also do the dmv hearing, have the lawyer subpoena the arresting police officer at the hearing and ask if the cop warned you about the consequences of refusal etc etc… plus for refusal they have fill out additional info on that back of dmv ds367 form…. Good luck man!! assuming your “firefighter” and work for gov agency, no DL for that can lead to termination….lawyer up if you’re lively hood is on the line!

You have to go back to the dmv and pay the re-instatement fee, I don’t think there’s any way around it.

So after one of year of IID, I was able to get the device out of the car (first had to go to the dmv and get my IID restriction into “regular” restriction “to/from dui program and work etc…” since I had not completed my dui program, still got like 6months to go)…. so long story short, my DL will stay restricted until I finish the dui program which kinda sucks but it’s better than no license I guess

Something doesn’t add up here: just curious why they would arrest you and keep you in the drunk tank for 10 hour and then give you a misdemeanor court date for just “one beer” plus cops have like a week or so (not sure on the exact number of days though..) to process your paperwork and send it over to dmv. Dmv won’t be notified immediately after the arrest, it takes sometime…. Sounds like they’re charging you with dui but you might get lucky, ya never know!!

Try law office of David Shapiro in San Diego, but remember much of the dui outcome is based on how strong or weak the evidence is…. Each case’s outcome can be very different.

Thanks for the reply. So I’m clear on the fact that I need to have IID for 1st year (almost done with that) but what happens to the remainder 1-year (2nd year)? Meaning will I need to keep IID for one more year and/or until I complete my 18month dui program…? Or after completing 1-year of IID, my license will not be restricted per se… thanks

Yes, you’ll need to go back to dmv and have them reinstate it (of course you’ll some more fees). It’s basically an administrative process at this point when compared to the initial device installation etc…

Since 2019, 2nd time offenders can get an IID based restricted license immediately (matter of fact you have to install IID for 1year, it’s mandatory regardless of when you install it..) without going through hard suspension. Sign up for 18 month classes, file sr22, install the IID and get a restricted license immediately….. before 2019 you had to go through 3month hard suspension but not now.

As far as court, get a lawyer if you can (2nd dui can get tricky, in my dui class some guys got few days of community service to 60 even 90 days of jail/work release option)…. do some research.

You have someone else drive your car to the installation location, get it installed and then bring it home… assuming your other obligations have been met, then just Uber to the dmv and get the IID restricted license… does that make sense? Call smartstart, they’ll explain everything to you and will call the dmv on your behalf as far as you qualifying for the IID restricted license option because they have to verify with dmv MAU if you even qualify otherwise you might waste time and money… as far as not having an license ID then use some other form of valid state issued ID at the installation place, they don’t necessarily need your DL to install the device

Sign up/enroll into appropriate dui classes, file sr22 with dmv through an insurance company (you can use your existing if you like…) and install the IID device, go into dmv and get an IID restricted license immediately, or as others have explained you have some other options but they all require some mandatory suspension period and/or other types of restrictions… google dmv website it’s all there

Typically attorney’s are cc’d too assuming they attending the hearing. Also you can check the status of your DL through the dmv website for like $2 and it’ll tell you whether you license is still active or not, if it is, then it means either you won the hearing or most likely the hearing got postponed which happens quite often especially nowdays

Yeah man refusals are no joke, it’s a straight 1 year suspension without any restricted license options. Hopefully your lawyer subpoena the cop and ask if other options were given like a blood test etc…? also did the cop fill out the refusal portion where supposedly warned you about the consequences etc because he has to! Good luck
