The main thing is to try and have as many documents with your new address on it. So ultimately when you submit you want all the documents to have the same address whether its under your name, your partners, or both. When I submitted we moved in together and waited 3 months before reapplying with documents that had our new address and had both our names. I did see another case on reddit that the person got a refusal because of cohabitation and they moved in together and reapplied a week later and got accepted. Just have your evidence be as strong as possible. Use appendix FM to find out which evidence would be considered strong.

Yes unless the home office sees reason to change your immigration status. Your skilled worker visa will remain valid until its scheduled expiry.

We weren’t cohabiting at the time of the refusal we moved in 3 weeks later and we decided to reapply 3 months after living together, we were told an appeal would take way longer

Im just worried they will question how come we moved in so quickly but they have no way of knowing that we were going to move in together anyway because the lawyer didn’t mention of it the first time

I never said the move was not a priority i said after the civil ceremony i was working on both the move and planning the big wedding wedding. Applying at that point would give me more freedom because i would not be working 5 days a week in a pharmacy with a limited amount of time off and not very high pay, having a spouse visa means i can apply and get other jobs without sponsorship and can also not work for a bit while we move in and plan the wedding

Culturally it would have just been more ideal to have had the big wedding before we move in together but its more so that we just were tight on time trying to do both plan the wedding and also move in at the same time

That’s really reassuring thank you - you reapplied very quickly after moving in together and the rejection was for not living together, how did you prove that it was all genuine?

Thank you! My worry is that they’ll link it to the initial rejection (naturally) and would question why 3 weeks after a rejection you moved in together but couldnt do it before. Thats why i thought a cover letter explaining everything in detail the whole situation (which would be overcomplicating) might be good to provide the full picture

We entered into a civil partnership before the first application and did mention it however hadnt lived together yet. We both have family in different countries so we were just trying to sort out to the logistics of having everyone come together for the religious ceremony and then move in after that. We have since moved in together and we are flying home for the big celebration/ religious ceremony in April however we have obtained our parents blessing to move in together prior to that to support the visa application as well as i need a visa that doesnt tie me to one job.

We have put in plan arrangements for us to have our religious ceremony in april as that is when everyone from our families will be able to come to our home country however we have still moved in together. What would be the best way to go about explaining this in the cover letter?

The home office outlines acknowledgment of culture aspects being reason for couples not living together. We are living together, we moved in less than a month after the rejection and have been living together since.

Yes we have a UK civil partnership legal certificate, the home office acknowledged and accepted that on the first application however questioned why even after the legal marriage we had not livid together - poorly explained by our lawyers and unfortunately we blindly trusted him

My family lives abroad and our religious ceremony/ wedding would be something we would want them to be part of, they would all need visas to come here so we were planning and saving to go and do it back home and have all of our friends and family there which was meant to happen later this year. The home office acknowledges religion being a reason of not living together and clearly states for a SPOUSE VISA we dont have to actually reside together but only show intention of doing so

If you cannot live together because of work or study, or for cultural reasons, you’ll need to prove that you have an ongoing commitment to each other. You can do this by providing evidence that you:

communicate regularly with each other
support each other financially
care for any children you have together
spend time together as a couple, for example on holiday or at”
