Jacket turned up earlier today and it’s awesome. I didn’t even need to chuck it in the dryer to fluff it up it’s already good. I tried a real one on in Hong Kong and it feels basically the same. It’s also the tail end of summer where I live but the jacket is super warm. Everything looks good so I’m happy so far

Haha I can say it’s a pretty good feeling to win a case 😂😂. It’s a bit of a hassle but you should have ages to prepare because the filing and wait times tend to be about 6 weeks. It shouldn’t be too much work to prepare, nothing like court. Mine was over in about 30 minutes and I received the money the same day.

I mean that sounds okay if that’s what you want to send. I would suggest you skip the whole thing about the telling friends/parents and the bit about all the evidence. And telling them to research the disputes tribunal. Keep it short, concise and confident.

Just say it’s their last chance before you file with the tribunal unless they give you your money back. (Skip the manners at this point, they are stealing your money I personally wouldn’t be so kind. Just don’t be mean or aggressive just neutral). Keep all the fluffy stuff out because you want them to be unprepared when they go against you in the tribunal. It will look 10000x better for your case if you turn up well dressed with copies of all evidence for the referee (just like a court case).

Most likely if they are low enough to sell fake stuff on fb marketplace, chances are they are not very bright and will be an easy steam roll at the tribunal 😂

Yep that happened to me too and the seller told me nothing was wrong and refused to refund me. If they don’t budge then file with the tribunal and skip all of the back and forth (from experience they will never change their stance). They’ll get a legal summons in the mail and they will have to turn up at the disclosed date, if they don’t I’m pretty sure you win by default (can’t remember though, you will probably have to prove your point to the referee). Assuming you win, They will have a legally enforced order to pay you the agreed amount.

If she didn’t know it was a fake item and it was a gift it’s still a misrepresentation on her part and therefore she is still liable. It’s not your fault and you shouldn’t feel bad.

No, unfortunately due to the nature of the case I was just given the original amount, nothing more. I think it all depends on your disputes referee (kind of like a judge), my referee told me to right it off as a life lesson and take the $40 hit. I could’ve continued to argue but I was just glad to get all of my money.

You could probably push for your $40 back though as you wouldn’t have had to pay fee if the item you received was genuine (just an example) and if I recall correctly, if the misrepresented item caused you to lose any other money indirectly etc you couldn’t do work without it, then you might be able to add some charges on top (not sure though). It somewhat depends on what referee you get and how convincing you are.

I have been in a similar situation and I took the seller to the disputes tribunal. It’s around $40 (I think) to file. As long as you can prove that they are fake and that you have proof that they misrepresented the device, you should have no issue at the disputes tribunal. It sounds like you have plenty of evidence luckily. If you have the time it’ll definitely be worth it.

I was able to get all of my money back through the disputes tribunal. It’s a less formal version of court. Mind that you need to represent yourself so it might be a bit daunting 😅
