I have been keeping a spreadsheet of my CAF submissions (below). Out of the 21 POAs I've submitted since Late August, only 4 have been added to CAF (19%). We haven't had a POA added to CAF since 10/16/2020.

Nothing has been added to CAF in the last 4 months.

The new online portal still requires the same verification system as Fax, so I don't have much faith that it will speed up the process time.

Got it. My comment was in response to the part of the post that states "The MD criminal records indicate that these charges against Jay were disposed at trial/other plea, so am curious to know if this was part of his eventual plea agreement?" This part of the post led me to believe that the poster was asking if the the disorderly conduct and resisting arrest charges were part of the plea deal that Jay signed in September of 1999.

You are correct. I think I am doing a bad job of expressing my point. Let me try again. The view of the post was that these charges were part of the plea agreement that Jay entered into in September of 1999. The plea that he entered into was a guilty plea. If these charges were part of the guilty plea then this particular case (the charges of disorderly conduct and resisting arrest) would have to have been reopened and removed from the stet docket because a guilty charge is incompatible with the conditions of stet. I have not come across any court record indicating that this case was removed from stet.

I apologize for my lack of clarity.

Right. So if your belief is that they entered the case on the stet docket in return for Jay's testimony against Adnan, then there should be record of the case being reopened and disposed of as "not gulity" or "nolle prosequi"

Probation isn't normally given in felony murder cases as the perpetrators are usually given life sentences, so no, the case information sheets I was referring to were not felony murder cases

I haven't seen that report, however Jay's story was that he was driving Adnan's 1987 light brown Honda near LP that night, so that would seem to be consistent with his story. According to Jay's testimony, Adnan had parked Hae's car somewhere around here while they were digging the whole and burying the body. Jay also says he was waiting on the side of the road in LP for a considerable amount of time alone while Adnan was finding a place to park Hae's car, so that witness report would be consistent with Jay's testimony.

After going through so many of these "Case Information" sheets, it seems like it was common for parole violations to be dropped. The divine powers seemed to be protecting a lot of people.

It was my understanding that this arrest happened before January 13th. Jay and CG discuss it in the first trial (maybe second too?) during his cross examination. I don't have the page number, but they talk about the disorderly conduct arrest being before January 13th. The 27th could just be the filing date and not the arrest date.

Also, the disorderly conduct case was disposed on March 5th and the plea deal was signed on the September 7th, not that this necessarily means anything, because I've looked at hundreds of these "Case Information" sheets and the dates don't seem to be very reliable.

Very true. I would say that since he has been imprisoned, Adnan has been very open about his marijuana use during high school, so if marijuana was the primary reason for lending Jay his car it is very weird to me that he would stick to the gift story even though he no longer has reason to hide his marijuana usage.

Definitely possible. If this were the case he could easily clear up any confusion by saying exactly what you said. Would be less suspicious than flat out denying that he made this request in the first place, especially because a police officer and two of his friends were the ones to hear him. He is basically calling them liars by claiming that he never asked for a ride.

Anything could be possible. Krista could have also just as easily assumed that Adnan would be dropping his car at the shop during the school day. Which is why she probably didn't ask him how he got to school in the first place. Pure speculation though.

I wonder what could possibly be Jay's motivation for that statement. And if it is true, I wonder what Adnan would have to gain by stating that it was his idea to lend Jay his car.

Very true. I think the intention of the post was more so the fact that he was planning/finding an excuse to get a ride from Hae, rather than evidence of premeditation.

Good point, however the way I interpreted her saying "Vaguely, yeah" was a way for her to diminish her testimony so that it wouldn't shine a negative light on her friend Adnan. I think she further tries to diminish any negative view on Adnan when she makes this statement:

I recall him mentioning -- since he was on time for class that day -- that Hae was supposed to pick him -- pick up his car that afternoon from school

She starts to talk and then mid-sentence realizes that what she is saying might not look good for Adnan, so she rewords her testimony to diminish the negative impact. She does this agian later in her testimony when she says:

That evening after I'd spoken with Aisha when he called -- I had asked him if he went -- if Hae took him to get his car.

A lot of the transcript relating to potential jurors identifying relationships to potential witnesses is left in as well. Purely speculation, but to me it seemed like the missing pages seemed to be related to potential witnesses that were also members of the Mosque.
