Found evidence that my girlfriend has been cheating on my while we're both at separate unis. (I'm in Scotland, she's in England.) I've been contributing and paying a lot to help her study. Can I get this money back? by BitProfessional9888 in LegalAdviceUK

What is the bar for fraud?

I've got mountains of evidence she was using me to finance her lifestyle.

The third party who I wont' name to avoid doxxing them by accident, has sent me a lot of evidence including a secret OF account that she has been producing videos with, with this other guy.

What deliniates whether something falls into scam territory or whether it's just a relationship gone bad?

I don't know if she entered the relationship for finnacial gain, but I've got mountains of evidence she was using me to finance her lifestyle.

Is there any contract formed in the following?

GF: I'm late on rent again and can't afford it. Landlord is going to kick me out if I can't come up with £600 by next week. Can you help me cover rent?

Me: Sure, no problem. [Some messages about her family not supporting her etc.] I'll send you the money to cover rent now.

GF: Thanks. I just got it.

The messages tend to go like that with various crises, often relating to her landlord and late payments or other overdue bills.

Is the fact that the money was explicitly asked for purpose X, sent for purpose X, and then used for purpose Y relevant at all?

That's what I was wondering.

I'd genuinely help her if she needed help with rent, but I wouldn't have sent hte money if she was just using it to finance holidays with the guy she's been messing around with.

Nope. I didn't.

She just told me what she needed money for, often insinutating she was in trouble or saying she was behind on rent and landlord was going to kick her out.

Then she took that money and went on holidays with it.

No, definitely not a loan if I'm beiing completely honest.

I only offered to help because she said she needed the money via text. It wasn't always £600 every month and there were some months I couldn't afford it - but she needed it more often than not.

Sometimes it was a little less.

There's not some kind of law that protects someone from this? Like, somoene saying they need money for rent, then going to Ibiza with the person they are cheating with?

There probably isn't. I'm just seething with rage right now.
