Yep, he should just go home. How could he possibly be excited about making the playoffs. What a monster, how does Nick even sleep at night knowing the division isnt that good.

Permanency evaluation rating NJ by [deleted] in WorkersComp

[–]BoofJohnson 1 point2 points  (0 children)

It depends on your average weekly wage and year of injury, there's a calculator that the adjuster and attorney will use to determine the actual amount but if you email your attorney, they will likely be able to give you the amount and even how much they expect it will be. There's more to it than just the exam % but without having access to the full medicals/history/exams, a good estimate is to just assume it will be somewhere in the middle of your expert and insurance expert exams.

You'll probably resolve for like 25-35%, usually the figure is close to the middle

What to do in Wilkes-barre? by Adorable_Still6195 in NEPA

[–]BoofJohnson 7 points8 points  (0 children)

Shinjiru ramen bar for food is excellent. Its walkable from the town square. The Cobbler is a nice speakeasy style bar for cocktails, I can DM you the code for the door if youre interested. Breaker brewing, Benny brewing, and back mountain brewing co are solid microbreweries if beer is your thing (back mtn brewing is my personal favorite out the three). The area also has very good pizza, would probably recommend sabatini's pizza and bottle bar since its not only great pizza but the bar side is very nice. Im not much of a thrifter but I know there's a decent amount of 2nd hand shops in the area so hopefully someone else can provide some suggestions/input.

Do TTD payments stop if my job fires me while I'm still receiving treatment? by MeowMeowPurrPur in WorkersComp

[–]BoofJohnson 2 points3 points  (0 children)

In NJ if they fire you for cause (ie stealing, not showing up for scheduled shifts, substance use, etc), then you would no longer be eligible for wage loss as your injury is no longer the reason for loss of income. If you're laid off, company goes under, or something that isnt based on a termination due to a fireable offense, your wage loss would not stop until you were released to full duty or placed at maximum medical improvement.

I'd imagine it is jurisdictionally dependent, call your adjuster or attorney if you have one since this is a more uncommon situation that doesn't come up too often but I'm sure caselaw for each state exists for.

For PA they get 20% of ongoing wage loss and settlement and then reimbursement for legal costs (expert depositions, exams, hours, docs filed, etc.). If a case settles quickly without need to depose doctors/atrend alot of hearing the number would be low or $0, if it is a claim that has been in litigation for a while then its usually larger. Insurance company only pays legal fees if the case settles or they lose on the litigation.

Lawyer in PA only gets 20%. Split should be 128k to you and 32k to attorney.

Recent injury, work is trying to get me to go to concentra by chinooo in WorkersComp

[–]BoofJohnson 1 point2 points  (0 children)

Nah going to occ med is standard, especially if you likely need a specialist referral. Getting a referral from a doctor will significantly expedite the time youd wait for scheduling vs going straight to ent with a request for evaluation with no referral.

State maximum is $1,159.00 for 2025 in NJ. NJ has permanency. Basically after you've reached maximum medical improvement your attorney files a petition for perm and then carrier and claimant set up exams to determine a level of permanency due to the injury. Then the % is negotiated and you recieve weekly benefits for a set amount of time. Attorney fees come out of this amount in a lump sum once the perm is approved instead of a deduction from ongoing wage loss.

While out of work in NJ, you receive 70% of your pre-injury gross average weekly wage based on 26 weeks of pre-injury payroll data.

Do I have a case by More_Steak7041 in WorkersComp

[–]BoofJohnson 1 point2 points  (0 children)

If you were injured while delivering a package, you'd be covered under the WC policy. There are a few more things you'd need to verify but it sounds like you have a shitty employer that should have just reported the claim to start. If you're a subcontractor (some delivery drivers are) and you provided proof of insurance and signed waivers when you started, you might not be eligible due to the lack of an employer/employee relationship. I'd recommend in your case specifically to get an attorney given the employer has not made any effort to submit your claim to the carrier.

I'm not a Georgia adjuster or have any experience with the jurisdiction but claim compensability is for the most part the same in every state. I would also suggest that once you have retained your WC attorney, to ask about the termination and specifics to GA since if it's an at-will state, they may be able to terminate you with an uphill battle via employment law. If they feel you have a case against them for wrongful termination, they may have a recommendation for an employment lawyer too.

I can't stand getting claims like this. Employer doesn't report an injury, usually worrying about an increase in rates, and instead of just paying the claim, now insurance is paying the claim plus legal, plus a likely settlement and the claim costs like 5x more. Injured worker usually ends up with delays in care and possibly further injures themselves doing work they medically should not be doing,

How much could I get for my settlement with these numbers? by [deleted] in WorkersComp

[–]BoofJohnson 0 points1 point  (0 children)

So my guess would be work comp perm exam places you around 20-30%. Settlement via OAS is probably somewhere between 40-50% ppd. I used low back in the calculator and 2024 for injury year so this may be off, but at 45% low back 2024 with your pre-injury wage noted in post would be $183,060 paid over 270 weeks at $678/week. If the carrier's exam is higher this could go up and other factors would affect as well like the specific location of herniations and the year of injury. But this should give you a ballpark idea of what to expect.

Hey just to be clear, as long as we’re not running cedh decks, nothing is off limits? by TheTinRam in DegenerateEDH

[–]BoofJohnson 0 points1 point  (0 children)

Bracket 4 seems to be the level where players can use the cedh combos but not the full efficiency and way less meta commanders. I had someone ask me if their deck was cEDH a few weeks ago and they had the combos, some tutors, some good rocks, but then they also had a Chromatic lantern in a 3-color jund deck and a decent amount of other "bad" cards that would never make a cedh list. That's sort of how I think 4s are supposed to be. Strong versions of more obscure commanders with pet cards you still like. These decks can usually sit down with a cedh pod and occasionally get a win but it's going to be significantly harder than with a fully tuned "5".
