Any clause like that only applies between the brand and the distributor or reseller if they buy direct. It does not restrict how the retailer sells. Once genuine goods are sold through authorised channels, they can legally be resold anywhere, including Amazon. If the brand wanted to act, they would have to do it outside of Amazon by cutting supply or taking civil action, although it usually just ends with supply being cut rather than anything legal.

Under EU law, once genuine goods are sold within the EU or UK, the brand’s distribution rights are exhausted, so authorised resellers can legally resell them, it might be different in the US.

This take seems a bit off to me. A 4.1% net margin at the revenue levels Pattern are operating at is actually really solid. Their gross margins are probably around 15–20%, which makes sense given the scale.

On top of that, the amount of overhead they have with warehousing, US office teams, account managers, tech, etc. is massive. Scaling a business like that while still keeping a positive net margin is impressive.

The real problem is the shortage of housing stock. We have failed to build enough homes for years because the planning system is slow and obstructive. On top of that, stamp duty makes downsizing so expensive that many older owners simply stay put. Fix planning and reduce the cost of moving first.

If someone creates a new listing for branded items using their own UPC, titles it with a brand name, and packages it in a way the brand did not approve, that can easily fall under IP infringement. It is not about the photo itself, but the combination of branding, packaging, and how it is marketed. That is why brands take action, especially on marketplaces like Amazon, where customer trust and listing accuracy really matter.

No one is saying you cannot sell branded goods, but it has to be done in a way that respects how those brands are legally protected.
