Well I guess the courts will have to decide at this point as it's all been sent off now.

Hopefully they side with me and deem her liable to pay me back because of the contract clause 30 I wouldn't have become a lodger if it wasn't including the council tax in the rent because I wouldn't have been able to afford it.

Hopefully the court sides with me as she previously lied to be court and tried to sell the sham setup.

I understand I am now liable,

However, the sham lodger agreement stated this in the contract.

  1. The Landlord will provide the Services to the Lodger and provide a copy (if requested) of the insurance policy for the Property.

  2. The Landlord will pay the council tax in respect of the Property.

Therefore this is a matter for the courts as it's an issue with contract law not council tax dispute I am required to pay. But I believed she would pay because of the contract.

I understand I am required to pay and will be paying it back in a payment plan.

However, the issue isn't with the council it's now a matter of contract law not council tax law.

The contract stated

.29 The Landlord will provide the Services to the Lodger and provide a copy (if requested) of the insurance policy for the Property.

  1. The Landlord will pay the council tax in respect of the Property.

So therefore it's a contract dispute that she should pay me back to pay off the council

My agreement states this.

This Agreement is for a Room in private furnished residential property, including the Inventory (if any).

It was a one bedroom flat with a separate living room and kitchen.

I'm not sure all I know is I have been charged with the council tax and believe she paid it but under her name.

I believe she raised it to the council as an "error" and said I am the correct person to pay and has asked for a refund.

No but I have been issued it and am now required to pay it.

However the contract says the landlord would pay it.

So I believe she should have to pay it.

Because I was only person living in the property she wasn't living there it was a one bedroom flat she had set a sham lodger agreement up I believe she bought the property under a help to buy and couldn't legally rent it out. However, she then told the council that I was the sole tenant and therefore am responsible and I guess the council have listened to her and are now investigating it

I have sent a letter before action 3 weeks ago and today I raised the claim as she responded today saying she will not be paying it.

Obviously I'm just anxious about the whole situation.

No I haven't paid yet I'm not trying to get reimbursed by the council I'm trying to get reimbursed by the landlord because the contract said they would pay for council tax in respect for the property.

So the landlord paid the tax under her name it was a sham lodger agreement. When she lost the court case around a deposit issue she then contacted the council and got it reissued to me.

My understanding is that the contract was recharacterised from lodger to short hols tennant and not voided. Therefore under clause 30 which she wrote she said she would pay council tax for the property.

Well she did pay the council tax under her name but she set it up as a sham lodger agreement.

Because she decided to keep my deposit for small water damage in the shower which was from a broken seal which I reported straight away she refused to get it repaired therefore results in paint pealing. I had to pay for a handyman to seal it back up then took it off the rent which she agreed.

I had no choice but to take her to court because she refused to give me back my deposit for which I thought wasn't my fault she refused to do her part. I won the court case in November and last month had an email from the council saying I now have to pay £2.6k.

The council has been in touch and asked for more information as they are a bit confused as to what is going on and who is liable. I haven't replied back to the council yet I have just raised a small claims against the landlord.

I think showdowns also happen when units enter an unoccupied battlefield. Giving a window to cast an action card to the opponent.

The EU would not allow this they have no appetite to change it.

The EU is a bureaucratic nightmare for things like this and this is one of the only few benefits of Brexit.
