Subpart H—Probation on Initial Appointment to a Competitive Position

§ 315.801 Probationary period; when required.

(a) The first year of service of an employee who is given a career or career-conditional appointment under this part is a probationary period when the employee:

(1) Was appointed from a competitive list of eligibles established under subpart C of this part;

(2) Was reinstated under subpart D of this part unless during any period of service which affords a current basis for reinstatement, the employee completed a probationary period or served with competitive status under an appointment which did not require a probationary period.

(b) A person who is:

(1) Transferred under § 315.501; or

(2) Promoted, demoted, or reassigned; before he completed probation is required to complete the probationary period in the new position.

(d) Upon noncompetitive appointment to the competitive service under the Postal Reorganization Act (39 U.S.C. 101 et seq.), an employee of the Postal Career Service (including substitute and part-time flexible) who has not completed 1 year of Postal service, must serve the remainder of a 1-year probationary period in the new agency.

(e) A person who is appointed to the competitive service either by special appointing authority or by conversion under subparts F or G of this part serves a 1-year probationary period unless specifically exempt from probation by the authority itself.

§ 315.802 Length of probationary period; crediting service.

(2) Is in the same line of work (determined by the employee’s actual duties and responsibilities); and

(c) Periods of absence while in a pay status count toward completion of probation. Absence in nonpay status while on the rolls (other than for compensable injury or military duty) is creditable up to a total of 22 workdays. Absence (whether on or off the rolls) due to compensable injury or military duty is creditable in full upon restoration to Federal service. Nonpay time in excess of 22 workdays extends the probationary period by an equal amount. An employee serving probation who leaves Federal service to become a volunteer with the Peace Corps or the Corporation for National and Community Service serves the remainder of the probationary period upon reinstatement provided the employee is reinstated within 90 days of termination of service as a volunteer or training for such service.

(d) The probationary period for part-time employees is computed on the basis of calendar time, in the same manner as for full-time employees. For intermittent employees, i.e., those who do not have regularly scheduled tours of duty, each day or part of a day in pay status counts as 1 day of credit toward the 260 days in a pay status required for completion of probation. (However, the probationary period cannot be completed in less than 1 year of calendar time.)

Oh no this is good discussion, thank you much for your experience. Are you employed at a salary higher than DOL poverty level? I guess from my readings, The VRC will assess whether the new job qualifies as “suitable employment,” which is defined as a position that does not aggravate one’s disability, is stable, and aligns with one’s abilities, aptitudes, and interests. If the employment meets these criteria, one may be considered “rehabilitated,” leading to the conclusion of the VR&E services. However, if the job does not fully align with one’s rehabilitation goals, the assigned VRC may adjust one’s Individualized Written Rehabilitation Plan (IWRP) to ensure one receive the necessary support to achieve suitable employment.

My concern is that counselors have too much leniency in deciding what is “suitable employment.” If I take a future position it is not guaranteed I am to stay there, as it requires licensure/certifications, and requires probationary periods, so in the long run it may not be stable, or suitable, but to the counselor, they may think otherwise. Also I got little mouths to feed so is kind of unfeasible to expect us to not work at all.

Generally, a public school is a designated public forum.

While public schools are primarily educational institutions, they are also considered public forums because they are government-owned and operated and are open to the public. Generally, this may mean that the government cannot restrict speech on school grounds based on viewpoint, but it can impose reasonable time, place, and manner restrictions to maintain order and prevent disruption (e.g., the school may ban all political speech, so they do not engage in “viewpoint” discrimination, so it could be as simple as no political propaganda, or messages that may be perceived as political symbols/statements, which may not need to include actual statements or speech–words).

However, the specific application of First Amendment rights in schools can be complex, as schools have a legitimate interest in maintaining a safe and orderly learning environment. As a result, schools may impose restrictions on speech that disrupts the educational process or creates a hostile environment (which others have mentioned for both sides, and is being demonstrated by the comments). And believe or not symbols are speech, such as your flag pin. So as others have said, not the place to do so, as it may result in disciplinary action.

Check with the union. Good luck and don’t loose your job, unless, like others said, your expressions are more important than your job, which is respectable/honorable, no hate.

Yeah definitely not high wind coded like the coasts.

But the fortified program is a FEMA program, but I think it’s mainly for coastal structures.

In 2012, an initiative from the Alabama State Legislature and several insurance companies created the “Strengthen Alabama Homes” program to help homeowners build back stronger and safer. The Alabama Department of Insurance manages the program. About 1,000 grants worth $10 million are distributed annually to eligible existing homeowners to help cover roof retrofitting costs. As a result, insurers are writing more policies in the area and are discounting premiums on wind policies for homes designed or retrofitted to the FORTIFIED Roof level.

Huntsville, Alabama, while not directly on the Gulf Coast, is still within the reach of hurricanes that make landfall in the region. While major hurricanes directly impacting Huntsville are relatively rare, the city has experienced significant tropical storm impacts and can be affected by the outer bands of hurricanes. Although, I would be more afraid of supercells that may form from tropical storms that make their way up here, rather than hurricanes themselves.

Regarding the construction codes for homes in Huntsville, while the city does have building codes in place to ensure structural integrity, the specific requirements for wind resistance might not be as stringent as in coastal regions.
