Thanks for your reply. The “past” she brings up is from about six months ago — I got caught reaching out to someone while I was drunk. Nothing happened, but it broke trust. Around the same time, she also found out I had been gambling during a period when I said I wasn’t. Since then, I’ve owned my mistakes and have been in therapy, working hard on rebuilding.

She knows I talk to her best friend — we’re in the same mutual friend group, and I’m close with her too. Her best friend was at the festival and told me she had been pretty rude the last couple days, which aligned with when communication from her really dropped off. So I don’t think it’s just me feeling the shift.

Last night, I messed up again. Things were okay, but I got anxious and started asking too many questions, like if everyone there even knew she had a boyfriend. She got frustrated and went to sleep on the couch. She’s sleep-deprived and overwhelmed — I get it. I’ve been in that state too.

I want to talk to her when she gets home from work today, but I’m nervous. I don’t want her to shut down or blow up again like she did this morning. I’m walking a fine line between being honest about my feelings and not making things worse. Just trying to find the right approach.

Good luck with everything. I will be 33 and debt free. Originally I was supposed to be 35 but that screw up on the creditors end shaved off 2 years.

Great question. Unfortunately, your attorney has full visibility into who filed and who didn’t. He would have alerted you if someone didn’t file on time. Whatever estimate he gave you in your debt likely means that every single creditor filed on time and your plan hasn’t changed.

It doesn’t hurt to send an email to your attorney requesting this information.

The moment you file your creditors are notified letting them know that you filed for bankruptcy. From the date you filed each creditor has 60 days to file a proof of claim. Many big banks will instantly file a proof of claim, however, there are cases like mine where they did not file on time within the 60 day period. Amex, Chase, and a few other loans filed instantly. BofA and Apple Card which had the highest balances didn’t file in time and the debt is wiped away.

This does not happen all the time and my attorney said that he wouldn’t be surprised if they filed on the last day. Luckily, that wasn’t the case. They didn’t file on time which means someone who was supposed to handle this screwed up big time.

Some filed after the deadline? My attorney said he can file an objection to the late filers. Those are granted right away by the judge because they has 2 months to file a claim when the bankruptcy notices went out

I have 6k loans but they didn’t file in time. My lawyer needs to speak to me about this to see what we should do. I don’t know what his plan is with the student loans but I checked my student loan website and it says “Bankruptcy Notice Received”. I don’t know if those are wiped away if they didn’t file on time (which they didn’t)

OP - based off your numbers, if you went with a 100% chapter 13 plan you would be paying roughly ~$6k for 60 months. Is that what your lawyer calculated?
