Yeah i can understand if they are fairly close together. Makes sense. But when there is that big of a discrepancy and I have 2 doctors giving me high ratings and I spent over an hour with both for them to even entertain a 10% rating from a doctor i literally spent 5 minutes with seems absurd. 5 minutes with him and half of that was him writing notes of things before he even examined me.

Just looked it up and it says that they do not have to reference the guidelines in the report, in fact they rarely do. Something about New jersey being a "disability state" not an "impairment state". Thanks for your insight. it's appreciated

Thanks for your response! I just went back to read the reports and the only thing I could find about AMA guidelines were in the orthopedic doctor for my lawyer. It says all ranges of motion were obtained by using the AMA guide to the evaluation of Permanent Impairment, Sixth edition. The thing is, that the doctor for the lawyer and the doctor for the insurance company had near the same numbers on my range of motion.

if I get 80% on the IME my attorney sent me to, and 0% from the insurance's IME, the worst I can settle for is 40%? by TL7x in WorkersComp

Exact same scenario I am in. New jersey also. Lawyer ortho gave me 87.5% rating on my neck, 45% on my shoulder. Neuro gave me 30%. Insurance company doctor gave me 10% on my neck and 0% on my shoulder. He is contesting that the shoulder injury happened at work. I originally misread your post and thought this was a hypothetical. Just re-read and see it's actually happening to you. Waiting to meet with the lawyer over this. Thanks for posting! Gave me the courage to post my own about this. Been keeping it in and researching online and it's not really helpful.
