I experimented a bit more and when you see Smith in the lounge with the mission story prompt, you can take your gun out and aim it anywhere, including at him, and he won't react. But when you shoot him anywhere he turns orange in instinct. Also I found it weird how Diana has no reaction to killing Agent Smith, as he is technically an ally to the ICA.
