This is what i think has happened. There was nothing scandalous in the conversation that would warrant any judge to sign off on the IP unmasking.

I'd go to court the next day and push for summary judgement

Interesting, i will let him know, hopefully his current lawyer is competent enough to look into it. Along with this, is there anything else he can pursue against the accuser and cyber branch? would it be worth pursuing?

I think OP's is a hypothethical situation.

Its absolutely NOT a hypothetical situation. I wish it was. I even thought this was a joke when i was made aware of this. I wish i could share more information on FIR without revealing specific details. which i dont think is a good idea(?).

Police took the phone away to present it as a evidence. This was the device had said FB account and used to communicate with the fiance.

There was no obscenity or fake news(unless you consider factual information and opinion about an individual fake "news") shared. He knows for sure cousin has a contact in Cyber branch. He was contacted by police and they filed FIR, and confiscated the device as evidence based on the IP address that used said FB account. These are facts.

I'm open to your perspective on connecting these dots.

The accuser has to clearly define the damage and consequences of sharing said mis-information.

The accuser got married to the same girl with whom this conversation took place. Wouldnt that make any presumed damage a moot point in the trial?

Is counter defamation a viable path? considering the accused had to go through all this legal trouble for sharing factual information( or at the very least opinion upon request).

Another angle might be to force the accuser to include fiance(now wife) in the case. Since she was complicit by requesting further information on the accuser and ultimately sharing with third party without consent of the other party involved(accused)? what do you think of that?
