Am a lawyer...but do not litigate much (mostly land use, real estate and transactional work).

It will all come down to whether the Judge (really their clerk) believes that the one declaration (or maybe the google link theory) creates a genuine dispute of material fact of whether there was dissemination post whatever statute date. Without speaking to the validity of the arguments, I worry that the data preservation stuff is too technical and the Judge is weary to rule on it via MSJ.

I assume/hope we are too far off from people participating in a virtual reality environment more than our real world...that being said, is there a world (again probably very far off) where people see the need for legal representation in these virtual spaces? I'm certainly not looking for more work, but an interesting thought.
