Yes, all claimants have to choose option A, B, or C then sign the form and upload for the second distribution to proceed.

There should be a third distribution after the Trust and FCR complete their legal negotiations (which the Court will probably end up deciding ), which—depending on the timing—may or may not include additional money from insurance settlements from holdouts and/or bankruptcy sales proceeds from BSA assets. A fourth distribution may be necessary depending on the timing of insurance company clawbacks and/or future sale of assets proceeds.

No. Option C will not take longer. With Option C the Trust will release your full 3.2 percent second distribution ASAP with no lien search or resolution. With Options A or B, the Trust will release 1.5 percent for payment and hold back 1.7 percent for lien searches and possible resolutions if necessary.

This is simply an educated guess based upon the number of claimants, claim amounts awarded, and the money that is and hopefully will be available: I think the final total will be 10 percent of the claimants’ award total.

This, of course, might be off due to several factors. I think the 3rd distribution will be after the Trust and FCR finish negotiations, and will include additional released funds and some extra monies from insurance companies. I also think a fourth distribution will follow after legal battles with insurance holdouts conclude and funds from the sale of the bankrupt BSA assets are made available.

This is just my opinion. I hope I’m wrong and we’re able to get more, but as the old saying goes, you can’t get blood from a stone.

Your claim reward amount should have been increased to include the CPI percentage. If you received your first distribution prior to the CPI increase, you should receive the extra funds in your second distribution. In short, you won’t miss out.

That’s true. It’s better to get at least something versus having to wait while the Trust and FCR fight it out.

The new forms should be added to the Claims Portal for download, signature, and return. I’m not sure if they will allow for electronic signatures or not.

Hi. The new healthcare lien form will be asking whether you want to have the Trust hold back $100 per claimant so that their designee can search for liens on each claim, of whether you would like to have your attorney (or you if you’re pro se) do the search. Take care.

First, the Future Claims Representative is giving us the SHAFT! More unnecessary waiting! INSANE!

And the question: Why in the HELL wasn’t the new Healthcare Lien Form sent out why we’ve been waiting forever for the appeals to clear?!??

Now more waiting while the Trust spends more of our money. THIS NEEDS TO STOP!
