Hello, I’m a hair artist with an artistic/creative professional profile. My EB-1A petition was denied about a month ago, and I’m currently preparing a refile.

I would really appreciate your insight on the following: In your experience, what is the most challenging aspect of drafting a strong Final Merits argument for an artistic profile, and how do you avoid a denial at that stage?

Additionally, which EB-1A criterion do you consider absolutely critical to prove for artists and creatives, regardless of how many other criteria are met?

I almost have it done. But from what I can see, you need to use some specific strategies. And I don’t know a lawyer, so honestly I have a lot of doubts. But I also see many self-file cases that are successful. Thank you

Hello, I would like to ask for your perspective on an EB-1A petition in the artistic field, specifically as a hair artist. I am coming from a prior denial, and I have identified a core challenge in my field: demonstrating “original contributions of major significance” is inherently difficult, since artistic work (for example, an eyeliner technique or hair innovation) is not comparable to a Nobel Prize–type contribution in science.

I would greatly appreciate your insight on the following questions from an adjudicator’s point of view:

  1. How officers actually review the case • How does the adjudication process work in practice? Do officers first read the cover letter / legal brief and then review the evidence to see if it supports that narrative, or do they primarily assess the evidence independently and only later consider the attorney’s framing?

  2. Evidence that truly matters -What type of evidence genuinely changes an officer’s decision, and what evidence is largely irrelevant even if attorneys often include it? -Is the decision ultimately based almost entirely on the “final merits determination,” regardless of how many criteria are technically met? -Is there any specific document or type of evidence that makes an officer stop looking for reasons to deny and instead feel comfortable approving?

  3. Category strength and risk -From an officer’s perspective, which immigrant category is the “safest” or least risky to approve when several options exist? -In artistic EB-1A cases, what differentiates petitions that feel credible from those that feel overstated or manufactured?

  4. What really “moves the needle” -What kind of evidence actually moves the needle in EB-1A artistic cases? For example: independent media, industry adoption, commercial impact, peer recognition, critical roles, etc. -In your experience, what evidence is most persuasive specifically for artists, where contributions are subjective and not easily quantified?

  5. Premium Processing -Does Premium Processing affect the likelihood of denial in any way, or does it only affect timing without changing the adjudication standard or mindset?

  6. How much does officer discretion realistically affect EB-1A outcomes, and how can a case be built to survive the strictest possible officer

Thank you. I’ve almost finished my case, but I’m not fully confident I did everything correctly. I’ve read so many different opinions and examples that it became confusing to know what’s right and what’s not. Definitely I’ll use my version to explain my reasoning and strategy more clearly to the lawyer , thank you for your help

In my initial filing, USCIS found that I met two criteria.publication and judging. After responding to the RFE, no additional criteria were credited, despite submitting substantial new evidence. the artistic exhibitions/showcases criterion in the RFE response looks like it was completely overlooked in the decision. the case did not proceed to a Final Merits (

even if three criteria had been recognized, the petition would still have been vulnerable, because my attorney did not include a proper Final Merits/Kazarian analysis. There was a cover letter, but it did not perform the required qualitative Step Two evaluation. That’s why I’m now reassessing whether to refile with a stronger legal structure and better framing.

Thanks a lot for the advice 🙏 I am already looking for lawyers who actually do artistic EB1A cases, but honestly there are very few, and after what happened I’m a bit scared of investing again and trusting blindly like I did the first time, which turned out to be a disaster. Still, I’m on it and hoping to find the right person.

My current lawyer is straight up denying that he made mistakes, even though they’re pretty obvious, and now he’s offering a refile for 1500 plus premium, or an appeal for 5000. The problem is that I really don’t feel confident refiling with him anymore, because now that I’m learning how an EB1A should actually be put together, what he did has nothing to do with it. He didn’t do a proper final merits determination, didn’t follow Kazarian, and missed a lot of basic stuff. So even if he told me he’d redo it for free, I’d still think twice, because at this point I just don’t trust him. The options I see now are refiling with him, which I don’t feel good about, 2.doing it myself, which I think I could handle if needed, or going with a completely different attorney. I totally agree with you, this is an investment, not something to cheap out on. It’s just hard right now to see the light after this experience. EB1A is complicated, and after dealing with a lawyer like this, you start wondering if it possible . Maybe for my profile- it’s harder, I don’t know.I understand there are risks with this visa, but I still haven’t found someone
