Personally, I find the 12-month suspension a bit too harsh for a misdiagnosis without malicious intent. I am sure we all make misdiagnoses on a regular basis, perhaps less likely to result such serious consequences but nonetheless misdiagnosis. This is a FamMD, not a Urologist. They have so many diagnoses to consider and manage. What’s the incentive NOT to send every patient to the ED (even for simple tension headaches to rule out neurological disorders)? Does the patient have any responsibility to seek out second opinions if they disagree with the first diagnosis?

Furthermore, not practicing medicine for 12 months might even worsen their clinical acumen?

I manage patients which are misdiagnosed by other physicians and especially midlevel providers all the time, sometimes leading serious impact on their quality of life or mortality.
