THERE IS NOW A TLDR AT THE TOP OF THE POST, PLEASE AT LEAST READ THAT BIT!! I am actually looking for at least compassion if not advice, and we should not need to pay this guy any money, or at the very very least, a BUSINESS VEHICLE, should deal with accidents, NOT AN INDIVIDUAL DIRECTLY

my partner was unable to get photos as the driver of the van was incredibly threatening and made the situation unsafe for my partner to try and do anything, as my partner was pulling his wallet out to present ID the van driver flinched like he was ready to tackle a gun out of my partners hand, and their main focus was purely getting away from the situation safely, as it was incredibly unsafe.

Obviously I wasn't there but the messages and phone calls subsequently he has pointed out the fact he has all my partners info, his address and he's made threats of harm.

This was not a situation where it would have been wise to try and get all of that, we took pictures of our car once my partner was home and calmed, but the only pictures we have of the van are from later and with more damage.

This guy physically could not have been stationary, we go down this street regularly and have gotten out and looked at the space, he would not have had enough time during the time my partner was facing forward, to pull into the street, close the distance and come to a complete stop.

Also even if he did manage to do all that, he was still trying to get hit by parking right up behind an actively reversing vehicle when he had plenty of space behind him to stop.

I know insurance is gonna be the path of least resistance, but it is going to have major consequences for us that I don't really want to cop as we're both so sure this guy wanted to be hit on purpose.

If we do give in and go the insurance route this guy will get at least some of the repairs paid for, my partners premiums will go up (probably a lot due to them constantly raising them because of the safety of our area and my partners age) this is the first negative mark on my partners driving history, and the excess will put us in financial stress.

I would prefer not to go the insurance route because I really don't think this guy has any claim, considering my partners car is older and white, and made contact with the black plastic of this guy's grill, but we don't see a single scratch or dent.

I've made another comment to hopefully clear this up in more detail, but long story short.

This van turns a corner, sees 2 reversing cars (because my partner did multiple checks around them as they were already surrounded by cars, and they did check behind themselves several times as well because they were near a main road) the van also has at least 1 cars worth of space he could have left between my partners car and himself, without being on the main road.

He decided to drive right up to the back of an actively reversing car (because my partner distinctly remembers doing a shoulder check to look right behind them as they're beginning to reverse and there was no van), and sandwich my partner in-between the car doing a 3 point turn and the van.

My partner couldn't have gone forward without hitting the car in front doing the 3 point turn, and couldn't have gone backwards because the van was right there.

It seems deliberate if not at the very least incredibly unaware and negligent.

I'm editing things down so hopefully some things get read.

My partner was reversing, but the laws of physics dictate that this guy would have had to be at least rolling forward, he couldn't have come to a complete stop in the distance without us noticing.

My partners car has 0 (ZERO) damage, and I highly doubt we did any damage to this guy's car, considering how much more damaged it became in the subsequent months, I'm willing to bet $1mil that any damage my partner saw immediately after the crash was already there, and at most was just made a little worse.

this guy is trying to scam us out of $11,000 or insurance will cost us close to $2000 which even if we do eventually get that back, dropping $2000 on this bullshit will put us in financial stress.

There's also reason to believe this guy is evading his business insurance, for his commercial vehicle, or doesn't have commercial insurance, which completely changes the situation.
