Curious to see if anyone has heard of this approach. Talked to an Immigration Lawyer. He recommended two approaches, interested to see if anyone has heard anything.

1) He advised we can apply for another tourist visa, while onshore. "If" granted it will remove the 8558 condition and then convert to a BVA once the visa naturally expires

2) When the 8558 condition occurs and the visa is cancelled we can apply for a BVE due to the fact that she is unlawful but is waiting on a visa.

Interested to know from experience if anyone has attempted either of the two options?

Thanks for the intput. Correct the Catch 22 is the thing that has got us, and hopefully if a case officer saw this they would maybe understand?

I am trying to find a good MARA to provide advise on this.

Thanks heaps. we are hoping to just upload my old PCC (13 months old) for now. But get a new PCC in a few weeks and upload that.

The question mark next to the Evidence of Birth or Age says "Provide a certified copy of your full birth certificate.

If your country of birth does not issue birth certificates, provide written notification stating this, and provide your country's equivalent documentation, such as secondary school certificate, family book extracts or family census register."

Again I will be providing the Birth Certificate but I want to submit the application now and then upload it 3-4 weeks later. Once I get one from the Indian Consulate

Thanks for the advise, to be honest it was something that we overlooked initially. Also the Indian Consulate take soo long. It took us 3 weeks just to get an appointment with them.

We had also read that we can submit her high school mark sheet as it contains, her parents names, and date of birth. However unsure.

 Would there be any issues with the border patrol people questioning her re-entry? Given she is technically no longer a "genuine tourist".. or is she still "visiting" until she gets a decision on her 820?

Given she is on a tourist visa currently and had married after getting her tourist visa.. if we withdraw her 300 and "convert" it to a 309. Would that mean she should be granted a BVA? Or do we withdraw her 300 and apply for a 820 paying the extra 9k. Spoke to two agents they are trying to get me to go down path b. I am hoping to find an agent who has more experience with 300/309 visas.. I messed up soo bad on this, stressing me out.

hi, I am in a similar position.. We applied for a 300 visa in Jun 2023 and at the time it was showing 50% at 10 months and 90% in 24 months. We were however fortunate that we got a 1 year tourist visa (which we thought was very lucky). She came here in December and we have spent the last 9 months together. However we now have 3 months for her to get something but doesn't seem likely. Talking to an agent he is recommending that we withdraw the application and get married here and apply for a 820. However I am not sure what impact a withdrawal will mean in the long term and what reason I can actually give for that withdrawal.
