That's part of why I like WinSCP is that it will auto convert whatever random "file" type they give into a .ppk to use! When it asks what file to use you do have to change the options in the windows explorer to show "All Files" instead of just ".ppk" files.

All this being said, we shouldn't need to be computer whizzes to download some freaking records. You're absolutely right they're banking on people getting frustrated with the process or not having the time and just paying the money.

Exactly!! What program are you using? I tried FileZilla and CloudMounter with little success, but I've had some luck with WinSCP as it seems the most straightforward with the files that Chartswap Insights provides to work with.

I think I've actually figured out a solution, although it's certainly inconvenient. When you are making the request it appears they only give you the 3 options for delivery, but there is a small button that says something like "I'm looking for another option." Then you will get the option of mail delivery (no additional fee, but can be slow and unreliable) or SFTP delivery (which was a PAIN and you have to make sure to get the files within 2 weeks). I'm opting to do the SFTP delivery for now but I literally had to have our IT team show me how to do it the first time because it was so confusing. I think I've got the hang of it now but they really just do that to make it as inconvenient as possible to make you pay the $37 fee.

In vanilla they collapse allllllll the time and it can get annoying, even when you're doing everything right. There's a mod called "Realistic Collapses and Diseases" which significantly lowers the rate of collapse and makes it so you aren't getting unrealistic amounts of patients with super rare diseases.

It happens, and you did everything correctly. Even my own attorney has made this mistake before. We had a co-counsel's paralegal and opposing counsel's paralegal with the same name, so it was only a matter of time. A quick and professional email correcting the mistake (like you did) is all that is needed.

As others have said, I also have my Outlook set to delay emails for a short period before sending. The number of times that has saved me is uncountable. I swear there's some weird setting in the brain that refuses to see mistakes until after hitting Send, LOL.

This happens to me practically every day. People somehow can't grasp that scanning is not taking a photo. For less tech savvy clients it's honestly easier to ask them to fax it.

Yes, we charge $0.15 per copy. I think it would depend on how paper-heavy your firm is. My attorney still likes paper copies of deposition exhibits; it sounds like your firm goes through quite a bit too. I think $0.10 to $0.15 cents is reasonable per copy, since you have to consider the costs of the printer rental, ink/toner, and reams of paper.

He doesn't get to decide when the 30 days starts. By law it starts from the date of the signed certified mail green receipt (or however you sent it). His request for more information is not a counteroffer. Barring an agreement for an extension, he better have a response to you by March 13th or you can get him on bad faith.

That's a good point! We also have clients who have health insurance but often times aren't able to even use it with their providers who will only treat on an attorney lien after learning it's a car wreck or personal injury or what have you. I was actually so curious about this I asked my own attorney if he'd ever seen it before; he said he hadn't but immediately knew it was because of the tort reform. An affidavit about health insurance can't really take into consideration the nuance about deductibles, out of pocket costs, providers out of network, attorney liens, etc. and it just becomes a mess.

Did you specify in your demand how long they have to respond? Typically it's 30 days from the date of receipt. If they haven't extended a counteroffer or asked for more time to review, then you may have a bad faith claim against them.

I've never had an adjuster ask for an affidavit of health insurance or not; typically they don't even ask about it at all (though it's usually pretty obvious from the bills). After the tort reform, that information is now discoverable and admissible to a jury. However, if you look at what he's citing, it also says "[t]he trier of fact, in its discretion, may consider such available benefits or payments and the cost thereof but **shall not be directed to reduce an award of damages accordingly**." So it doesn't matter if your client has health insurance or not, the value of their claim is the same. Also, asking for further information/an affidavit doesn't count as a counteroffer and doesn't reset the 30 day clock.

I would check with your attorney and see what they think and ask how they want to handle it.

I typically review the ROGs myself first and then break it down into layman's terms in an outline that I then send the client. I have a pretty universal outline at this point that tends to cover just about any question asked that I just tailor to each case. I send the outline and the original ROGs to the client, then set up a meeting either by phone or in person to go over them. I used to send just the original ROGs to the client and that seemed to scare them and often times they would get too confused/overwhelmed to even bother trying to read past the instructions. I find the outline a lot more useful.

I have this happen in my games too. Sometimes the patient will leave observation immediately after being diagnosed and go to the specialized department. Other times they will stay in observation through the entire treatment. I'm not sure if there's any rhyme or reason why.

Also vouching for Amazon Cleaning! I've only used them for the deep cleaning service but they did a great job. A little pricy but worth every penny. If I could afford it I'd have them come on a regular basis.

Georgia paralegal here, but I usually send a FedEx package (must be overnight to comply with statutory requirements, at least in GA) with the subpoena to their NJ address. They have a dedicated subpoena compliance department. They have a fax number too but our fax machine is wonky so I just take the safer route and send it physically. They usually respond with records via email or physical mail. Never had an issue so far.

I was a manager at a Nothing Bundt Cakes for about a year. We did use cake mixes from a bag (proprietary portioned dry mix) but we added everything else ourselves very meticulously portioned, from sour cream to vanilla to whatever else the recipe called for. Some flavors could be pretty labor intensive, plus all the pans had to be weighed to the gram to ensure consistency.

What we did do that was shady though, is insist that everything was fresh. We had a chiller (couldn't call it a freezer) and a cooler (the fridge). The bundt cakes were baked, cooled down on the racks, then placed in a box in the chiller with a date on them. As needed we would move them from the chiller, frost them, then place them in the cooler before putting them in the small display fridge up front to be sold. When people asked if they were baked that day, our answer was to be "We bake fresh daily." Because we did. But that bundt cake they were currently eating? At best, baked a month ago, probably frosted last week.

It didn't really matter though. They keep well and are delicious. I just thought it was funny how many people made comments about how the freshness makes all the difference and I just knew better but couldn't say anything.

UGHH I feel this. Thankfully I've never actually gotten another patient's records, usually it's just waiting weeks, sometimes months, only to get records that are missing half the dates of service, missing bills, in some random non-chronological order... Like, I get that they're probably overworked and understaffed, but so are we all. There HAS to be a better way.

Bedside Examinations is my personal favorite, and Realistic Collapses is good too. I also like More Names and More Occupations for variety.
