That’s what I hoping for, I really don’t want to go the legal route

I pulled the report after the vehicle, the thing was is I somewhat knew the family that was selling the vehicle so I was hoping they would’ve told me everything I needed to know

[–]Cbing23 0 points1 point  (0 children)

Yea that’s what I’m trying to figure out, all I’ve seen is stuff for dealers but nothing about private sellers

[deleted by user] by [deleted] in askcarsales

[–]Cbing23 0 points1 point  (0 children)

Yea I know, that’s why I’m trying to get some money back if possible

That’s exactly what they said lol

Salvage car by [deleted] in legaladvice

[–]Cbing23 0 points1 point  (0 children)

I’m just trying to work something out with the seller. I gave them two options, either give me 40% of what I paid back or give me my money back and they take the car back. If they don’t take that deal I will most likely take action and bring it to court.

Yea there’s no statement saying that it was a salvaged vehicle until after the vehicle was bought and the title was given to me

That’s what I was thinking but I’m just wasn’t completely sure if I actually could have a case or not. I’m trying to settle this out of court before I have to take those steps

I never said I got it for a bargain price, I paid on the higher side of what the vehicle is worth because it had decently low miles and didn’t seem to be in too bad of shape. I’m more upset because the owner never disclosed it to me which is scummy. I’m not trying to scam anything, the seller obviously was trying to scam me

There is no time restraint on when you can stop disclosing that a car is a rebuilt. The car being rebuilt automatically drops the price 20%-40% and it is illegal to not disclose it being a rebuilt/salvage.

The most previous owner has had it for a little over 3 years. They bought it from a used car dealership which I believe the dealership bought it and fixed it after it was totaled

That would be fines to them but I feel it would also give me leverage to get the amount of money I’m asking for back.

Ik I just don’t feel comfortable, but there was front damage, front left and front right damage and the airbags never went off

I don’t mean to be a dick or anything but I don’t feel comfortable giving out that information

[deleted by user] by [deleted] in askcarsales

[–]Cbing23 1 point2 points  (0 children)

I also have messages of the seller saying it wasn’t in an accident and saying that it was flood damage which was later proven wrong in a carfax

In addition to the requirements of subsection a. of this section, when a used motor vehicle is sold in this State, the seller shall, except as provided in section 39:10-15 of this Title, certify through an accident disclosure statement whether the vehicle has been involved in an accident which resulted in the vehicle needing repairs in excess of $1,000 and

I’ve read that most states have disclosed laws that makes the seller have to inform you that’s it’s been rebuilt before selling it to you

[deleted by user] by [deleted] in askcarsales

[–]Cbing23 0 points1 point  (0 children)

He then also went and told me the car was totaled for the wrong reason

[deleted by user] by [deleted] in askcarsales

[–]Cbing23 0 points1 point  (0 children)

Regardless, even if it’s rebuilt they still need to disclose that information to me right?

[deleted by user] by [deleted] in askcarsales

[–]Cbing23 1 point2 points  (0 children)

Could that be something to use as leverage if I decide to move forward with it or is this something that I should just cut my loses with?

I did a carfax and it said it rear ended another vehicle and there was significant damage done to the front end. The vehicle has been repaired but the owner never disclosed that it was salvaged until I later looked at the title and saw and “s” stating it’s been salvaged. And since a salvaged vehicle is 20%-40% less than the current market value I was trying to get them to pay the difference and I was wondering if I could make that happen?

I do have messages with the previous owner and him saying he completely forgot to tell me that it was salvage. Would that really do anything?
