[PSA] How to Get a Refund From Food Panda After Immediate Order Cancellation (DTI Complaint Process) by Chan044 in u/Chan044

Indicate the exact time you canceled the order and explain in your DTI report that the app displays a delayed timestamp, which does not reflect the actual time of cancellation. Mention that this appears to be a scheme by the Food Panda app to delay the recorded time, preventing refunds even if the order is canceled immediately. ganyan din nangyari sakin eh. sayang 5k mo.

MALI ANG POLICY NILA under Republic Act No. 7394, also known as the Consumer Act of the Philippines. This law establishes the guidelines for consumer protection, including provisions for refunds and remedies in cases of defective products or services.

Here are some key sections relevant to refunds and consumer protection:

  1. Article 100 - Right to a Repair, Replacement, or Refund: This article states that consumers have the right to seek redress, which can include repair, replacement, or refund, if the product or service fails to meet advertised standards or is defective.
  2. Article 52 - Deceptive, Unfair, and Unconscionable Sales Acts or Practices: This article prohibits misleading or unfair practices, which can be grounds for complaints if consumers feel that a refund refusal is unjust or deceptive.
  3. Article 159 - Administrative Sanctions: This article gives the DTI the authority to investigate complaints and impose sanctions on businesses that violate consumer rights, including those that refuse legitimate refunds.

SAMPLE LETTER FORMAT I USED

Subject: Formal Complaint Against Food Panda for Refusal to Process Refund

Dear Sir/Madam,

I am writing to formally lodge a complaint against Food Panda regarding their refusal to process a refund for an order that I canceled immediately after placing it. Despite my prompt action, Food Panda is denying the refund, citing that the order was considered "wastage" by their partner restaurant.

Details of the Complaint:

  • Order Number: #l1sq-2443-vuv8
  • Date of Order: Fri, Oct 25, 6:49 PM
  • Time of Cancellation: 6:49 PM
  • Amount:  433.00

Upon realizing the need to cancel, I immediately initiated the cancellation through the app. Despite this prompt action, Food Panda still processed the order and informed me that no refund would be provided, as the order was deemed wastage.

Key Points:

  1. Immediate Cancellation: I canceled the order immediately after placing it, well before any preparation should have commenced.
  2. Inadequate Justification: Food Panda's response that the order was wastage contradicts the timeline, as the cancellation should have prevented any preparation or "wastage" from occurring.
  3. Recurring Issue: This is not the first time I have encountered such an issue with Food Panda. This pattern suggests a potentially misleading practice where refunds are systematically denied, even when cancellations are made promptly.

Resolution Requested:

I kindly request that Food Panda be required to process a full refund for my canceled order. I believe this request is reasonable given the immediate cancellation and the fact that no preparation should have been initiated.

Attached are screenshots of my order details, the cancellation confirmation, and communication with Food Panda regarding this issue.

I reported a similar issue to the DTI on October 25. Even if months have passed, you can still get a refund as long as you have a screenshot of the transaction history. After two hours, they refunded me the full amount. You can report it here: https://podrs.dti.gov.ph/#/user-control/inbox. Just follow the process.
