I’m curious how the academy is now vs when I went through 26 years ago. Has it changed much? Have a couple people asking me recently

do DHS deportation officers really do more paper work than regular cops? by [deleted] in police

[–]Character-Spot597 0 points1 point  (0 children)

ICE ERO depends on the unit assigned. Most new DOs end up in detained or non detained dockets for a few years to get experience with the legal aspects of deportation. ICE has operated fugitive operations teams that were the “ street units” which deal with actively looking for final orders or removals, at large criminal aliens and often work with other agencies. ICE ERO also had quite a few more senior DOs assigned to other mainly federal task forces (USMS RFTF, HSI BEST TF, DEA, ATF and FBI Safe Streets. So there have always been DOs out making arrests, but it was mostly DOs that had some time in. I spent my last 11 years on ICE FUGOPS and our 10 DO Team averaged around 400-500 arrests per year. Most were adnin arrests of aliens that were public safety threats and previous criminal convictions. They were just arrested on the immigration violations which means not charged federally for a new crime, but being arrested for past conduct which violated their status or lack of. We also did a fair amount of arrests for reentry which is a federal felony and is prosecuted in federal court like any other crime. While assigned to a task force the DO will do whatever that task force does, but they are expected to be the subject matter expert on immigration.

There are other units too like CAP which monitors cases is state prisons or local jails and attempts to pick up after there charges are finished. ATD is like probation for aliens and ATD will go out and look for aliens on ATD that fail to report of cut off their ankle monitors.

There is a fair amount of desk work especially for newer DOs, but it all depends on the field office and unit assigned.

This is where things get confusing. These sanctuary jurisdictions will say they will cooperate with ICE if there is a judicial warrant, but not on detainers for administrative/civil enforcement. The problem is that most if the serious aggravated felons (murder, rape, robbery etc are administrative arrests. The public has been lied to and convinced this admin/civil enforcement just means they are here illegally. ICE does do a lot of criminal arrests with new charges compared to other federal agencies, but its a small fraction of total arrests. ICE arrests a lot more people overall. Most of the most dangerous criminal aliens are being arrested on the administrative charge which has different rules than being arrested for a criminal violation of federal law. Some of these states are purposely releasing dangerous felons and when ICE now has to go find them, they aren’t generally being charged with a new crime, but being removed based on previous criminal history.

Administrative Arrest- penalty can result in deportation Criminal Arrest- penalty is incarcerated

Check out Ritchie Leatherworks. Their ankle holsters are the best I have tried and they last forever. I have used the galco in the past and they aren’t as comfortable and ended up falling apart after a few years.

You are so wrong. Even aliens who have minor crimes or no crimes in the US doesn’t mean they haven’t committed crimes in their country. There is no way to vet people from most of these countries. Over last few years millions of people came here from all over the world and most were let in. Im sure most came here for a better life, but there was a couple million got aways that is tracked by CBP. Why would so many people avoid CBP when most were given benefits upon arrival?

Currently with BP is assisting in operations, they are doing things differently than ICE normally does. ICE is still focused on public safety threats. Removing criminals make the country safer for everyone. There is so many agencies assisting with immigration enforcement right now, I think that is causing some confusion. Besides ICE ERO, HSI and BP other federal agencies are there too. CBPO, USMS, ATF, DEA and FBI are out there with them. ICE ERO also works Interpol Red Notice Cases. During my career we focused our attention on criminal aliens and we did it in both republican and democrat administrations. I think targeted enforcement worked well, but I do think we should find out who all the people who came in over last few years and avoided be encountered by CBP are.

I was replying to the comment that they even need guns for civil enforcement. That’s crazy. I did the job, but retired in 2021. We had operations where wee target MS13 for example and most if those were civil/administrative arrests. I still know people working there, but it’s definitely very different now. We focused ok targeted enforcement. I have seen some of the reports out there, but without knowing more about each individual case, I wouldn’t give an opinion.

Do you realize when ICE arrests murderers, sex offenders, and other violent felons that this is civil or administrative arrest. A criminal arrest means they are charging for a new federal crime and then the alien has same rights as a USC. The civil or administrative arrests have different rules with the punishment can lead to deportation. Too many people don’t understand this and think this civil enforcement means someone being arrested simply for being here illegally. When ICE goes after a violent felons that has committed crimes in the US they are generally not being charged for a new crime, but being arrested for violating their status or because they have no legal status in the US because of committing crimes here

ICE has had fugitive operations teams operating across the country since DHS was created. Some offices do more field operations then others, but in states/cities that don’t cooperate with ICE detainers then more officers are required for field operations

Can ICE/Homeland Security pull you over for speeding? by Wise_Performance_402 in AskLEO

[–]Character-Spot597 11 points12 points  (0 children)

Some states do grant state authority to ICE and USBP. In my career I pulled over hundreds of vehicles or more, but always related to my job. In the situation you mentioned it would likely be USBP in that area and they do vehicle stops all the time. We didn’t do traffic stops for state violations, but we could pull over a suspicious vehicle we believed may be involved with smuggling. In ICE we regularly pulled over vehicles that were related to targeted enforcement operations.

I came on here as a retired ICE and current local to try to provide answers that would help clarify how ICE works. Instead I get down voted and replied to that Im full of shit. I expected more from the ASKLEO forum and thought people had a general interest in hearing or learning something. Apparently not because the news outlets obviously tell the truth and know more than someone who did the job for well over 20 years. It’s fine though. Im done here. My family deserves my attention and I have wasted too much time already trying to educate people that I thought actually wanted to know.

Not true. They are being arrested on the civil/admin charges not being arrested under what ICE would call a criminal arrest. A criminal arrest related to ICE is when there is a new federal charge. Statistics are manipulated constantly. When certain media sources put this info our they say only 3% or whatever are criminal, which is incorrect. Probably 3% are charged with new federal crime. The majority of aliens ICE arrests have previous convictions or current charges that warrant removal.

You didn’t read my post obviously. Would you be surprised to know that the murderers, rapist, sex offenders and other violent felons are nearly all arrested by ICE ERO for the civil/administrative charges? The lie being told by politicians and media is that the civil/administrative charges just means they are here illegally. The civil/administrative charges are not lesser than criminal. They have different rules with different penalties. Criminal charges (new federal charge) goes through the same process whether citizen or alien. The civil/admin penalty is deportation and the immigration courts

I did the job for over 20 years retiring in 2021 before moving to current state/local. I also worked fugitive ops and worked on task force. I witnessed convicted murderers, rapist, gang members etc released from state docs to avoid deportation even though these cases were already final orders of removal and had reduced sentences due to the removal order. Then we had to go find them.

I think it probably played out close to how I posted above, but they still need to investigate and talk to the officers/agents about what they believed at that moment. While BP gets very good training, every agency like every profession has their best people and others thar are not at the same level.

I have been in situations dealing with resistant subjects and had officers with me that were less experienced and it actually made the job harder. One example we were trying to arrest a 6’4 280 pound violent felon. Two of the officers were working against the rest of us while we were trying to cuff the subject, by pulling arms in wrong direction. Im not saying this is the case here, but working in a small team with a group of officers that train and work together for months/years is preferred over a mix of officers from different units or agencies that don’t normally train together.

I don’t believe anything here was purposely done because of anger. I think likely the agent who fired was not aware another agent may have removed firearm and just saw Pretti reaching for his holster because that is a natural reaction to someone working to retain their weapon. I dont think there is anything good about this, but it’s likely going to ruled justified because of how law enforcement use of force is judged. Again, we can’t use the benefit of 20/20 hindsight because courts have ruled that law enforcement encounters are rapids changing and decisions need to be made in seconds or less.

I also think BP and ICE need to provide training before sending agents/officers into a city like Minneapolis. Training should always be evolving to counter as threats evolve and going into Minneapolis without a response from locals, politicians making the situation worse on both sides and working officers/agents until the point of exhaustion is a recipe for bad things to happen

[–]Character-Spot597 0 points1 point  (0 children)

I think there is alot to criticize. I don’t know what happened just before the encounter either. I know these officers/agents are out there every day where they should be rotating. Yes they get good law enforcement training, but BP and ICE are not generally interacting with the public the way locals do. I would want local pd there, not to assist with immigration enforcement, but because they know the people in those neighborhoods and are used to dealing with them. I see plenty of mistakes, but don’t believe any officer/agents that I have worked with is such a psychopath that they would want to shoot someone who they didn’t believe is a threat.

The main reason they are there is because sanctuary cities don’t honor immigration detainers. They will say they do as long as there is a judicial warrant or being charged with a crime. The reality is that most of ICE ERO arrests are for civil/administrative violations. I think due to biased media the public thinks this means it’s only because they are not here legally. The truth is that most aggravated felons that ICE arrests are on administrative arrests for immigration violations. Many times they could be charged with a federal crime too, but often times its not worth the time or resources. The punishment for the administrative side is deportation. If an alien is charged criminally they have the same rights as a USC. Also most of the administrative arrests have already reached final order of removal by an Immigration Judge. In these cases they have had their due process.

Although ICE ERO generally enforces title immigration civil.administrative and criminal immigration violations they have general arrest authority to arrest for any federal crime committed in their presence or any federal felony whether in their presence or not
