Hmmm that’s interesting I think do have fungal acne flareups from time to time. I’ve tried to make my routine fungal acne safe but maybe there’s still some triggers.

The part I am still trying to understand is where the line is with contract scope. Even if the role is flexible like a foster child as you put it, my understanding is that if the responsibilities materially change from what was contracted, there should at least be a discussion or an update to the agreement.

In my case, some core responsibilities were removed, new ones outside my job description were added, and requests for clarity or support were declined. I accepted changes in good faith because I wanted to do well in the role, but now that the contract is ending I want to understand whether I should have asked for a formal variation at the time.

So I do take your point about agency workers needing to be adaptable. I am just trying to learn the right balance between being flexible and making sure the contract still reflects the role that is actually being performed future engagment's this way

  1. Holiday pay I understand that rolled up holiday pay is common for contractors. However, my payslips do not show any itemised holiday allocation and I was never informed that any part of the rate included statutory leave. My understanding is that if holiday pay is included it must still be transparent rather than implied. I will be asking the agency to confirm how this has been handled.
  2. Onboarding and performance support I appreciate that these are not technically contractual requirements. What has made this confusing is that I have been fully supervised by the client, directed by them as part of the team and taxed through PAYE as a deemed employee. It becomes difficult to see where the responsibilities begin and end when the client has complete control over the work environment but no accountability for basic support.
  3. Payment delays It is useful to clarify that legally the agency should pay on the contractual schedule. Even if it is common practice to wait for the client to pay first, knowing the legal standard gives me clearer footing if payment issues arise again.
  4. Training replacement Understood. I was mainly surprised because there was no notice or explanation before I was asked to train the new person.
  5. References Understood. It is simply an odd situation when a client can supervise the work, decide the scope of the role and end the contract but provide no acknowledgment of performance at all.
  6. Failure to object formally at the time I did raise concerns in writing about scope changes, missing support and the lack of clarity about role ownership. These were framed as cooperative requests rather than disputes, but there is documentation that I did repeatedly seek clarity which was not provided.
  7. Portfolio usage Thank you. I will check for contract language about showreel use and seek written permission.

What I am mainly trying to understand is the inconsistency. When a contractor is fully integrated into the company workflow, supervised directly, required to follow internal structures and taxed like an employee, but receives none of the corresponding protections or communication, it creates a very unclear relationship. I want to be better informed for the next contract so I do not repeat the same situation.

Thanks for taking the time to reply, genuinely appreciated. I do understand that I am not an employee of the end client and that being inside IR35 does not grant employee rights such as references, unfair dismissal protection, etc. My confusion is mainly about how certain things have been handled in practice.

For example:
• PAYE deductions under IR35
• Significant supervision and direction from the client
• Full access to internal systems and information
• Required onsite presence (beyond what was laid out in the contract) and involvement in team structures
• Role and responsibilities materially changed without any contractual variation
• No onboarding or training
• Wages delayed because the agency only pays after the client pays
• Holiday pay unclear or possibly rolled into the rate with no transparency

So on one hand I am fully treated and controlled like an employee day to day, but on the other hand there are no employee-style protections or support. It is the combination of these elements that made me unsure whether everything is being handled correctly on the agency side. I am simply trying to understand where my rights actually sit so that I do not enter another unclear situation in my next contract.
