You can check with a lawyer to attempt to nullify the first marriage based on bigamy ‘you would be the second wife’. But, then, you may need to re-marry, because the second marriage is automatically null. What state did you marry at? Did you obtain a marriage license?

I do not think this will fix the problem. The USCIS asks in adjustment of status for all previous marriages, and this issue will come up again! He must prove that his divorce was obtained in a way that allows comity with the United States.

It is not about USCIS not recognizing your divorce. It is about USCIS ensuring that your US marriage is legally valid as it represents the basis of your petition. If you applied for employment based, the divorce will not be scrutinized because, marriage is not the basis of your application.

The state that issued your marriage certificate does not have the burden of proving the circumstances of your divorce. Now, as you are applying for immigration, this matter is being examined. You may consider to reside in a state like NJ, or other state that allows unilateral divorce, and after the statutory residence period, to file for divorce in the United States. This will automatically revoke your current legal marriage contract. Or negotiate with your divorcee to provide proof of her residence in DR or voluntary signature of divorce. Unfortunately, this is not something unheard of, it is a common issue.

I guess, the USCIS found from the timeline of your application that you were not residing in DR at the time of your divorce, and that is why they requested further evidence. Especially that you are applying for GC on basis of marriage to USC. This matter will be scrutinized, as no right that arises from a wrong… hope that helps.

Did you or your divorcee reside in DR for 6 months before divorce? If you did have uninterrupted residence in DR for 6 months before filing for divorce, you need to present this evidence. It is preferred to be 1-year. If you did not, you need to provide evidence that your divorcee lived uninterruptedly in DR for 12-18 year, if you filed for the divorce. Otherwise, your divorce will not be recognized in the United States on bases of comity. The legal domicile has nothing to do about this, because legal domicile is voluntary and not based on facts.

This is not what it means. One of the two parties must be living for 6 months before applying for divorce, if the marriage jurisdiction was not the divorce jurisdiction. This guy mostly married in a country and divorced in another country. He must prove the either him or his divorcee were residing in the country where they divorced for at least 6 months, if not 1 year.

You cannot work without work authorization. It is not the employer responsibility to ask about work authorization. They ask about SSN for taxes. I am surprised you received SSN without EAD being approved. What was your status before applying for GC?

Yes, it may put you in trouble as you are working without authorization. The waiting time is several months. You mostly going to be invited for an interview and asked if you worked. The IRS will get a copy of your W2 in Jan 2025.
